3.10.010 - Definitions.

A. "Public facility" means any plant, building, structure, ground facility, utility system (as limited in Section 22002(c)(3) of the Public Contract Code), real property, streets and highways, or other public work improvement, owned, leased, or operated by the Town of Hillsborough, a municipal corporation.

B. "Public project" means any of the following:

  1. Construction, reconstruction, erection, alteration, renovation, improvement, demolition, and repair work involving any public facility.

  2. Painting or repainting any public facility.

  3. "Public project" does not include maintenance work such as routine, recurring, and usual work for the preservation of a public facility; minor repainting; landscape maintenance; or resurfacing streets at less than one inch.

3.10.020 - Formal bid.

Public projects with an estimated value exceeding two hundred thousand dollars shall be by written contract with the lowest responsible bidder in accordance with Public Contract Code Section 22037 as it may be amended from time to time, except as otherwise provided herein or by other applicable law.

3.10.030 - Informal bid.

Except as otherwise provided under Section 3.10.040, public projects with a value in the amount of two hundred thousand dollars or less shall be governed by the informal bid procedures as follows:

A. A list of qualified contractors shall be developed and maintained by the director of public works in accordance with the provisions of Section 22034 of the Public Contract Code and criteria promulgated from time to time by the California Uniform Construction Cost Accounting Commission as they may be amended from time to time.

B. Where a public project is to be performed, a notice inviting informal bids shall be e-mailed to all contractors for the category of work to be bid, as shown on the list developed in accordance with section 3.10.030.A, or delivered to the construction trade journals specified by the California Uniform Construction Cost Accounting Commission.

C. Authority to award informal bids is as follows:

  1. The public works director shall have the authority to award contracts up to thirty thousand dollars;

  2. The city manager together with the department commissioner shall have the authority to award contracts up to one hundred thousand dollars; and

  3. All contracts for public projects in excess of one hundred thousand dollars shall be approved by the city council.

D. If all bids received are in excess of two hundred thousand dollars, the city council may by four-fifth's vote pass a resolution awarding the informal contract to the lowest responsible bidder provided that:

  1. The city council determined that the original cost estimate by the town was reasonable.

  2. The contract is for two hundred twelve thousand five hundred dollars or less.

3.10.040 - No bid.

Public projects of sixty thousand dollars or less may be performed by employees of the town by force account, by negotiated contract, or by purchase order without formal or informal bid procedures.
