Hesperia Municipal Code Ch. 2.28 Community Development Commission

There is created and established in the city a community development commission.

A. There is a need for the Hesperia Community Development Commission to function within the city; and

B. The Hesperia Community Development Commission shall function on behalf of the Hesperia Community Redevelopment Agency, and certain nonprofit corporations as may be designated by the city council.

The city council declares itself to be the commission and their terms of office shall be concurrent with their terms of office as city council members.

A. The Hesperia Community Development Commission is authorized to transact business and exercise powers pursuant to Section 34100 et seq. of the California Health and Safety Code.

B. The Hesperia Community Development Commission shall govern and sit as the board of directors of the city's non-profit corporation(s), as they may exist from time to time; and possess all the powers, authorities, rights, and privileges thereto including entering into contractual agreements for administrative support and general operations.

C. Pursuant to Sections 34141 and 34149 the community development commission shall have additional powers regarding community development as follows:

To own, maintain, develop, manage, or dispose of real property assets vested in its name subject to the conditions and restrictions set forth upon the instrument(s) transferring said property to it. Initially, the real property assets shall be those commercial and industrial properties identified in Exhibit A of City Council Resolution No. 2011-024. There shall be no limitation on the number of, individual or portfolio value of the real properties held by the community development commission.

To apply for, implement, and administer private and public grants that support the overall mission of the community development commission, specifically economic development, affordable housing, community revitalization, education, etc.

Regular meetings of the Hesperia Community Development Commission shall be held at the same time and place as the city council meetings, or as prescribed by law.

Compensation of each commissioner shall be seventy-five dollars ($75.00) for each meeting of the Hesperia Community Development Commission attended by that commissioner. No commissioner shall receive compensation for attending more than two (2) meetings of the Hesperia Community Development Commission in any calendar month.
