Sec. 2-1. - City seal.

The city shall have and use a common seal, and the form thereof shall be as follows:

A gold circle; printed thereon in black "City of Hemet, Riverside County, California". Within said gold circle, on a white field, a narrow inner circle, within which at the top shall be printed the words "Incorporated", and at the bottom "January 1910". Within this circle on a white background there shall be a representation in black outlined in gold of Mt. San Jacinto with the sun rising behind the mountain, also in gold, to the left of which shall be a representation of the heads of the Indian couple, Ramona and Alessandro, wearing red headbands. To the right of the heads and centered in the circle there shall be an Indian tom tom. Below the tom tom there shall be an Indian peace pipe and tomahawk lying with handles crossed. The tom tom, peace pipe and tomahawk shall be in red and gold.

The peace pipe shall represent the peace of our valley, the tomahawk shall represent the industriousness of our people, and the tom tom shall represent the music in our hearts and minds.

Sec. 2-2. - Use of city seal or logo.

(a) Use of seal and logo. The city seal shall only be used for the official business of the City of Hemet, its city council, boards and commissions, committees, officers or departments, except upon approval of the city council by ordinance or resolution. Except as provided in this section, no person, other than the City of Hemet, shall reproduce, use, give away, sell or distribute any seal or logo, or facsimile thereof, purporting to be represented to be the city seal or city logo of the City of Hemet.

If used by an outside organization upon the approved, written consent of the city manager or designee, the seal or logo must remain in its entirety with no alterations. Elements may not be isolated and/or used alone or in combination with any other art. Specific sections may not be highlighted with other colors. Resolution must be clear when enlarged or reduced for reproduction.

All non-city usage, including non-profit usage, requires city manager or city council authorization.

The city manager shall promulgate an administrative policy regarding the use of the city seal and city logos by city staff.

(b) Prohibited uses of city seal and city logo. It is unlawful for any person or entity to make use of the city seal and/or the city logo or any portion, facsimile, mock-up, or reproduction thereof, or make or use of any design, symbol, emblem, insignia or similar device that is an imitation of said city seal or city logo, or that may be mistaken therefor, that is designed, intended or likely to confuse, deceive or mislead the public, for private or commercial purposes or for any purpose other than the official business of the city without the express written consent of the city council or city manager.

No person shall use the city seal or logo for purposes of supporting or opposing the nomination or election to any city or other public office of himself or herself or any other person, or for purposes of supporting or opposing any ballot measure, nor include such city seal or logo on any writing distributed for purposes of influencing the action of the electorate or any part thereof, in any election.

(c) Additional city seals. The city council retains the right to create variations of the city seal or city logo and to adopt and establish other official seals and logos. Such variations may include, but are not limited to, centennial seals, or other seals which mark anniversaries, events, and/or any other city occasion the city council wishes to commemorate.

(d) Amendment of city seal. The city seal may be altered pursuant to ordinance or resolution of the city council.

(e) Custodian of city seals. The city clerk shall be the official custodian of the city seal and any other seals adopted by the city council.

(f) Custodian of city logos. The city manager shall be the official custodian of city logos.

(g) Promotional use of city seal or logo. The city manager or his/her designee is empowered to authorize the use of the city seal or logo on items that are offered for sale by the City of Hemet for the purpose of promoting the City of Hemet.
