Sec. 14-351. - Findings.¶
The city council finds and declares as follows:
(1) That effective January 1, 1980, Health and Safety Code § 18550.5(a) is added to the state law, which provides as follows:
"1. An owner of a mobile home may remove or cause to be removed the tow bar, wheels, wheel hubs, or axles from a mobile home."
(2) That the removal of the tow bar, wheels, wheel hubs or axles, improperly accomplished, will result in an unstable mobile home or damage to the mobile home which may outweigh the value of the items so removed.
(3) That the removal of the tow bar, wheels, wheel hubs or axles from a mobile home, if improperly accomplished, will result in excessive expense to the owner thereof if it is required to move such mobile home thereafter.
(4) That the findings contained in this section require the immediate preservation of the public peace, health, safety and general welfare.

Sec. 14-352. - Definitions.¶
The following words, terms and phrases, when used in this division, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Mobile home means a structure transportable in one or more sections, designed and equipped to contain not more than two dwelling units and designed to be used with or without a foundation system. The term "mobile home" does not include a recreational vehicle, commercial coach or factory-built housing as defined in Health and Safety Code § 19971.

Sec. 14-353. - Permit required; inspections.¶
(a) It is unlawful for any person to remove or cause to be removed the tow bar, wheels, wheel hubs or axles from a mobile home without first obtaining a permit from the city.
(b) Upon issuance of a permit as provided in this section, an inspection shall be made prior to commencement of any removal, for the purposes set forth in this division, and after such removal for the purpose of preventing any instability or undue damage to the mobile home caused by such removal.

Sec. 14-354. - Permit fee.¶
The fee for issuance of the permit described in this division shall be as established by the city council. This fee may be amended from time to time by resolution.

Sec. 14-355. - Cutting tow bars or wheels.¶
It is unlawful to remove any tow bar, wheels, wheel hubs or axles from a mobile home by cutting, with a torch or by other means, unless the manufacturer's instructions provide for removal by such means.

Sec. 14-356. - Evidence of ownership and consent of owner required prior to removal.¶
It is unlawful for any person to remove or cause to be removed the tow bar, wheels, wheel hubs or axles from a mobile home without first providing evidence of ownership to the satisfaction of the city and the written consent from all persons who hold legal and registered title to the mobile home.

Sec. 14-357. - Exceptions to division.¶
This division shall not apply to dealers or manufacturers who comply with Health and Safety Code § 18550.5(b) and (c).

Sec. 14-358. - Violation of division; penalty.¶
Violation of this division shall be a misdemeanor punishable in accordance with section 1-8.
