Sec. 14-171. - Purpose of article.

The purpose of this article is to establish minimum standards for construction site maintenance, including standards for the collection, storage, containment and removal of construction site trash, rubbish or debris.

Sec. 14-172. - Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Construction site means any location where grading, construction of structures, remodeling, mobile home set-down, renovation or any other work subject to the issuance of a grading or building permit is occurring.

Construction site maintenance means the routine continuous maintenance of the construction site and adjacent areas in order to adequately contain the storage of trash, rubbish or other debris.

Construction site trash, rubbish or debris means any container, wrapper, crate or packaging that accompanies the construction material, any surplus or residual construction material brought to or originating at the construction site, and any other residual materials used by the construction workers and brought to the site.

Sec. 14-173. - Containment of refuse required.

There shall be containment of trash, rubbish and debris on a routine, continuous basis for each construction site, and there shall be no loose materials permitted to accumulate on the site or to be carried away by wind, water or animals.

Sec. 14-174. - Standards for containers.

Containers used for storage of trash, rubbish and debris at a construction site shall be approved containers leased from the city at the fee established from time to time by resolution of the city council. Containers shall be emptied when full, and under no circumstances shall any material be permitted to overfill the container. The building official may require such containers which, in his discretion, are best suited for the project. Generally, the following container sizes may be anticipated:

(1) A three-cubic-yard bin per dwelling unit, non-tract.

(2) A 30-cubic-yard bin per each ten dwelling units in tracts, and one per each building for apartment complexes.

(3) A 17-cubic-yard bin for each commercial or industrial building.

A different size container may be used when it can be demonstrated to the building official or the refuse superintendent that a different size container is of a sufficient size to adequately contain all trash, rubbish and debris during construction and for the proper removal thereof.

Sec. 14-175. - Placement of containers.

(a) Containers required by this article shall not be located in a manner or location that will block or constrict passage of a right-of-way, easement, public thoroughfare or other area where right of access may be required for the public health, safety or welfare.

(b) Containers shall be located on the construction site for each development, project or structure. When multiple lots or structures are being developed, containers shall be located in accordance with this article or as otherwise required by the building official.

Sec. 14-176. - Refuse removal.

Containers required by this article shall be placed at the time construction commences on the site. All trash, rubbish and debris shall be removed on a regular and timely basis from the site and transported to an approved disposal facility. Containers, as well as all debris, rubbish and trash, shall be removed from the site prior to final inspection. Containers that will remain after completion of the building may be emptied and placed in their permanent locations.

Sec. 14-177. - Responsibility for site maintenance.

It shall be the responsibility of the permittee or his agent to provide for construction site maintenance and the containment of all trash, rubbish and debris during construction and for the proper removal thereof.

Sec. 14-178. - Enforcement of article; inspections.

A violation of the provisions of this article shall be an infraction punishable as provided in section 1-8. Should noncompliance persist, in addition to other provisions of law, a stop work notice may be issued by the building official or other proper officers. All building or grading permit inspections, when made, shall include inspection to ensure compliance with the provisions of this article, and all final approvals shall be made only after such compliance. There shall be a fee for inspections after the first reinspection, in accordance with chapter 3 of the Uniform Administrative Code, to cover the costs of such inspections, when required to determine if compliance with the provisions of this article have been met.
