§ 1.10.010. Scope.¶
The provisions of this chapter shall apply to any primary, general, special or recall election held in this state.

§ 1.10.020. Definitions.¶
The following words and phrases, whenever used in this chapter, shall be construed as defined in this section:
"Appointed officer"
means any person appointed to an office, position or membership by the city council, city manager, or department head. "Appointed officer" also includes any employee of the city.
"Ballot measure"
means any Constitutional amendment, any proposition for the issuance of bonds, any advisory question or any other question or proposition submitted to the voters at any election.
"Candidate"
means an individual who is listed on the ballot or who has qualified to have write-in votes on his or her behalf counted by election officials, for nomination for or election to an elective office, or who receives a contribution or makes an expenditure or gives his or her consent for any other person to receive a contribution or make an expenditure with a view to bringing about his or her nomination or election to any elective office, whether or not the specific elective office for which he or she will seek nomination or election is known at the time the contribution is received or the expenditure is made and whether or not he or she has announced his or her candidacy or filed a declaration of candidacy at such time. A "candidate" also includes any officeholder who is the subject of a recall election.
"Elected office"
means any person who holds an elective office in the city or who has been elected to an elective office in the city but has not yet taken office. A person who is appointed to fill a vacant elective office in the city is an elected officer.
"Election"
means any primary, general, special or recall election held in this state.
"Elective office"
means any state, regional, county, municipal, district or judicial office which is filled at an election. "Elective office" also includes membership on a county central committee of a qualified political party.
"Endorsement"
means the act or process of endorsing.
"Facsimile"
means any replica, copy, duplicate, diminutive, image or other reproduction.
"Indicia"
means any distinctive marks, indications or postal markings imprinted on mail or on labels to be affixed to mail.
"Letterhead"
means any stationery printed or engraved with the name and address of the city of Hawthorne.
"Person"
includes a natural person, firm, group, association, partnership, corporation, organization or committee. "Person" also includes elected or appointed officers of the city.

§ 1.10.030. Prohibitions.¶
A. No person shall use the city letterhead, facsimile or indicia, whether or not printed at public expense, endorsing, opposing or supporting any ballot measure, proposition, initiative, referendum or candidate for elective office, prior to obtaining the approval of the city council by an affirmative vote of not less than a majority of its total membership.
B. No person shall use the city letterhead, facsimile or indicia, in any communication transmitted or otherwise disseminated to the public by mail, hand delivered or any other means, when the words "not printed at public expense" appear on the document, prior to obtaining the approval of the city council by an affirmative vote of not less than a majority of its total membership.

§ 1.10.040. Severability.¶
If any provision of this act or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.
