§ 12.04.010. Applicability of chapter provisions.

The provisions of this chapter shall apply to work herein described which is done or installed by any individual person, firm or corporation, and nothing herein provided shall prevent proceedings being taken under any improvement act from being done in accordance with plans and specifications or grades which are different from those provided for herein.

§ 12.04.020. Permit and compliance with chapter provisions required.

It is unlawful to install any sidewalk, curb, gutter or driveway without first securing a permit and complying with the requirements specified in this chapter.

§ 12.04.030. Application for permit—Fee.

Application for a permit shall be made in writing, filed with the City Clerk, specifying the location of such proposed sidewalks, curb, gutter or driveway, with details of the construction of the same, and shall be accompanied with a fee in an amount established by resolution of the City Council.

§ 12.04.040. Grades and staking—City Engineer duties.

Such application shall be delivered to the City Engineer, who shall proceed in a reasonable length of time to provide for the establishment of the alignment and grade for the improvement work, and provide for the proper stakes so that the work can be constructed according to the grade lines as fixed by the City Engineer.

§ 12.04.050. Construction specifications.

Such work of improvement must then be constructed in accordance with Specifications No. 1 for curbs, Specifications No. 2 for gutters, Specifications No. 3 for sidewalks, Specifications No. 4 for driveways, and Specifications No. 5, general. Specifications 1 through 5 were adopted by Resolution No. 63, dated September 5, 1950, by the City Council, which Specifications are hereby referred to and made a part of the ordinance codified in this chapter.

§ 12.04.060. Inspection and approval procedures.

A. Upon completion of installation of forms, and before pouring, the City Engineer or authorized representative shall be notified by the owner, contractor or person responsible for the work that it is ready to pour. If the work to this stage is found to conform to the Specifications referred to in Section 12.04.050, the City Engineer or authorized representative shall approve the work. It is unlawful to proceed further with the work until approval is obtained.

B. Upon completion of the work, the City Engineer or authorized representative shall be notified by the contractor, owner, or whoever is responsible for the work that it is completed and ready to be checked in relation to the alignment and grades. If found to conform to the true alignment and grade as set by the City Engineer and as so fixed by him or her, the City Engineer shall deliver to the owner a certificate showing that the improvement work has been done to line and grade so fixed by him or her, and to the abovementioned Specifications.

§ 12.04.070. Violation—Penalty.

Any person guilty of violating any of the provisions of this chapter, or performing any act declared by this chapter to be unlawful, shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine and/or imprisonment, in accordance with the general penalty provision then in effect in the City, pursuant to Chapter 1.08 of this code, as amended.
