Chapter 9.04 — OPEN ALCOHOL CONTAINERS

§ 9.04.010. Definitions.¶
As used in this chapter:
"Alley" means every way set apart for public travel except streets, bridle paths and footpaths.
"Parking lot" means that area open to the use of the public for the purposes of vehicular parking.
"Sidewalk" means that portion of a street between the curblines and the adjacent property lines, set aside for pedestrian travel.
"Street" or "highway" means a way or place, of whatever nature, publicly maintained and open to the use of the public for the purposes of vehicular traffic. (Ord. 233 §1, 1983)
§ 9.04.020. Consuming alcoholic beverages prohibited in certain public¶
places—Exceptions.
It is unlawful for any person to consume any alcoholic beverage, as defined in California Business and Professions Code Section 23004, upon any street, highway, alley, sidewalk or parking lot within the City. This section shall not be deemed to make punishable any act or acts which are prohibited by any law of the State. (Ord. 233 §2, 1983)
§ 9.04.030. Violation—Penalty.¶
Any person guilty of violating any of the provisions of this chapter, or performing any act declared by this chapter to be unlawful, shall be deemed guilty of an infraction, and upon conviction thereof shall be punished by a fine in accordance with the general penalty provision then in effect in the City, pursuant to Chapter 1.08 of this code, as amended.
