9.18.010 - Findings.

The city council finds and declares that problems associated with minors committing multiple violations of the city's municipal code creates an undue burden and hardship on city resources and the community.

The city council is charged with the responsibility of protecting this community from those minors who are at risk of committing more serious criminal conduct.

By adopting this chapter council intends to focus on parental responsibility as the primary deterrent to such juvenile misbehavior.

The city council finds and declares those minors who receive and are found responsible for three or more violations of the Grass Valley Municipal Code, specifically violations of the following sections: Section 9.12.010 trespassing, Section 9.14.040 unlawful presence, Section 10.64.030 skateboarding, Section 12.16.010 obstructing a public way, Section 12.32.050 improper conduct in a park or recreational area, Section 12.32.055 violation of special regulations pertaining to Elisabeth Daniels Park, and Section 12.32.070 entry into public park or recreation center after dark without a permit, during any twelve-month period are hereby classified as repeat juvenile offenders.

It is further declared that the parents or guardian of any minor classified as a repeat juvenile offender shall be issued a citation for knowingly allowing such minor to violate the provisions of this chapter.

9.18.020 - Definitions.

For the purposes of this chapter, the following definitions shall apply:

"Knowingly" means, after being previously advised by an officer of the Grass Valley police department, a parent or guardian having custody or care of the minor allows the minor to become a repeat juvenile offender as defined herein.

"Minor" means any person who has not yet attained the age of eighteen years as further defined in the California Family Code Section 6500.

"Repeat juvenile offender" means any minor who is cited and found responsible for three or more violations of the Grass Valley Municipal Code, specifically sections: Section 9.12.010 trespassing, Section 9.14.040 unlawful presence, Section 10.64.030 skateboarding, Section 12.16.010 obstructing a public way, Section 12.32.050 improper conduct in a park or recreational area, Section 12.32.055 violation of special regulations pertaining to Elisabeth Daniels Park, and Section 12.32.070 entry into a public park or recreation center after dark without a permit, during any consecutive twelve-month period.

"Reasonable effort" means the exertion of effort demonstrated by action or conduct by the parent or guardian which a reasonable person would find to be sufficient to curtail the illegal activity of the minor.

9.18.030 - Responsibility of parent or guardian—Violation.

It is unlawful for any parent or guardian having legal custody or care of a minor to knowingly allow or permit such minor to violate the provisions of this chapter. Parents or guardians having failed to demonstrate a reasonable effort to modify such juvenile misbehavior shall be cited for a violation of California Penal Code Section 272, Contributing to the Delinquency of a Minor, and subject to the fine and/or imprisonment, or both fine and imprisonment, so provided therein.
