2.16.010 - Established.

There is established a police department of the city consisting of a chief of police, a police force and such other officers, clerks and employees as the city council may, from time to time, prescribe.

2.16.020 - Members to be acquainted with laws.

It shall be the duty of each member of the police force to acquaint himself or herself with the provisions of the city charter, this code and all other ordinances of the city, and with all laws of the state defining public offenses and regulating criminal proceedings.

2.16.030 - Medical examination required.

A. All members of the police force shall be examined by medical personnel designated by the city council.

B. After the initial medical examination, police force members shall be given medical examinations by medical personnel designated by the city council as follows:

  1. Members under forty of age shall be examined every twenty-four months.

  2. Members over forty years of age shall be examined every twelve months.

C. All medical records created as a result of such medical examinations shall be confidential records of the City of Grass Valley pursuant to Section 6254 of the Government Code.

2.16.040 - POST standards.

A. The City of Grass Valley desires to qualify to receive aid from the State of California under the provisions of California Penal Code, Part 4, Title 4, Chapter 1, Section 13522.

B. Pursuant to Chapter 1, Section 13510(c), the City of Grass Valley will adhere to standards for recruitment and training established by the California Commission on Peace Officer Standards and Training (POST).

C. Pursuant to Chapter 1, Section 13512, the Commission and its representatives may make such inquiries as deemed appropriate by the Commission to ascertain that the City of Grass Valley public safety dispatcher personnel adhere to standards for selection and training established by the Commission on Peace Officer Standards and Training.

2.16.050 - Chief of police—Powers and duties.

A. The office of chief of police is established.

B. The city council shall appoint a chief of police and shall, by resolution, fix his or her compensation. The office of chief of police is a public office and a city merit system position; he or she shall not be removed from office without cause. The city council shall have the responsibility to give written notice to the chief of police stating the cause prior to the imposition of any discipline or action.

C. The police department of this city shall be under the control of the chief of police.

D. The chief of police shall be responsible for the execution of all laws and ordinances within the city.

E. The chief of police of the City of Grass Valley shall:

  1. Exercise the powers of control over the police department, including but not limited to, control and custody of police facilities and equipment, books, records, and all other property authorized for the use of the police department;

  2. Appoint one or more police officers subject to the approval of the city council or other appointing authority;

  3. Adopt and amend department rules and regulations which are not in conflict with any applicable federal or state statute. Such rules and regulations shall be binding on all members of the department and shall provide for, but not be limited to, the conduct of members, uniforms and equipment to be worn or used, hours of service, manpower deployment schedules, vacation schedules, leaves of absence, training, suspension and discipline, and other matters necessary or desirable for efficiency of the department;

  4. Appoint special, temporary or reserve police to preserve public order who may be entitled to compensation from the city. Special or temporary police officers shall obey all rules, regulations, and orders of the police department;

  5. Require that all members of the police department enforce all ordinances of the city, and all federal and state statutes applicable to, or delegating power of enforcement thereof to, the police department of the city.

F. The chief of police shall also:

  1. Preserve order and prevent violations of the law, and arrest violators thereof, and be responsible for the suppression of riot, public tumult, disturbance of the peace, or resistance against the laws or public authorities in the lawful exercise of their functions. The chief of police shall also exercise all the powers conferred upon sheriffs by general law and in all respects shall be entitled to the same protection;

  2. Take custody of all lost, abandoned or stolen property recovered in the city, and maintain an accurate accounting of it. He or she shall also assure the safety and protection of the property, and if the rightful owner is not found, he or she shall turn the property or proceeds of it over to an appropriate city officer, or otherwise dispose of such unclaimed property in the manner as may be prescribed by law;

  3. Keep a detailed and current record of all fees received for service of process or other money collected by his or her department or paid to him or her in his or her official capacity. Such record shall be open for public inspection during office hours;

  4. Deposit with the city treasurer or other designated authority all money collected by his or her department as required by law;

  5. Establish and maintain such other records pertaining to the conduct of police business as required by law, ordinance, resolution, competent authority, or efficient operation of the police department;

  6. Require that all officers and other department employees receive at least as much recruit and inservice training as the minimum prescribed by the California Commission on Peace Officer Standards and Training (POST);

  7. Appoint or designate a commanding officer to act in his or her place whenever he or she is absent from the city on authorized leave of absence or vacation, or otherwise so incapacitated or disabled from illness or injury as to preclude effective performance of his duties. Such commanding officer shall possess all of the authority and be responsible for the performance of all of the duties of the chief of police;

  8. Perform such other services as city regulations require;

  9. Make and maintain crime reports and other reports he or she deems advisable, and file copies of such reports, where required, with other public agencies as may be prescribed by law;

  10. Investigate all charges made against officer and other department employees by his or her subordinate officers, by citizens, or by higher authority. He or she shall assure that all evidence relating to alleged offenses is discovered and properly documented.

G. The chief may:

  1. Establish such divisions as may be necessary to discharge the duties of his or her office, and

  2. Designate personnel as necessary to assist him or her in the administration and supervisory discharge of his or her duties.

2.16.060 - Chief of police—Management of force.

The chief of police shall have control, management and direction of all members of the police department in the lawful exercise of his functions with full power to detail any of them to such public service as he may direct.
