12.24.010 - Applicability.

The provisions of this Chapter shall apply to the making of applications for and the granting and control of permits for the placing, erection, maintaining and removal of banners extending over, upon or along any highway or any portion thereof.

12.24.020 - Application.

An applicant for a banner permit shall complete and file with the City Engineer an application in duplicate conforming with the provisions of Section 12.04.070, which shall contain, in addition thereto, the following:

A. The location, dimensions and purpose of the banner;

B. A facsimile of the proposed banner, including any legend or written matter;

C. The proposed date and the time of day when the banner will be installed;

D. The proposed date and time of day when the banner will be removed;

E. Such other information as the City Engineer may require.

12.24.030 - Eligible bodies—Prohibited purposes.

Permits issued under this Chapter shall be granted only to civic organizations or public bodies for the purpose of bringing to the attention of the public, events which are of a general public interest. No permit shall be issued to further political, religious or private purposes.

12.24.040 - Term.

No permit shall be granted for a period of more than 40 days.

12.24.050 - Deposit.

Every applicant for a banner permit from whom an issuance fee is required and who does not maintain a sufficient deposit or undertaking with the City Engineer shall deposit with the City Engineer an amount as set by resolution of the City Council for each banner permit.

12.24.060 - Insurance required.

An applicant shall submit proof of public liability and property damage insurance to the Commissioner in amounts not less than the minimum coverage limits established by the City. Such insurance shall provide coverage for bodily injury or death to any one person, total liability for any one accident, and for property damage, as determined by the City's Risk Management Policies or applicable regulations.

The Commisioner may periodically review and adjust the required coverage limits to ensure they remain adequate based on current standards and risk assessments.

12.24.070 - Installation.

The City Engineer may require that the installation of any banner be under the supervision of an inspector appointed by the City Engineer, for which the permittee shall pay the City Engineer an amount equal to the compensation and cost of transportation of such inspector during the time he is assigned to such inspection.

12.24.080 - Deposit deductions—Refunds.

A. The City Engineer shall deduct from the deposit made or maintained by the permittee the following:

  1. The permit issuance fee if that has not otherwise been paid;

  2. The cost of the service and transportation of any inspector;

  3. The cost of any repairs made necessary because of installation of the banner.

B. The remainder of any such special deposit, if any, shall be refunded to the permittee.

12.24.090 - Removal of materials.

A permittee shall, upon the removal of any banner for which a permit under this Chapter has been issued, shall remove from the highway all material and debris resulting from the installation, maintenance or removal of any banner, within 24 hours after the removal of a banner.
