§ 5.13.010 DEFINITIONS.

For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

GARBAGE. Putrescible animal and vegetable wastes resulting from the handling, preparation, cooking and consumption of food.

LITTER. Garbage, refuse and rubbish, as defined herein, and all other waste material which, if thrown or deposited, as herein prohibited, tends to create a danger to public health, safety and welfare.

PUBLIC PLACE. Any and all streets, sidewalks, highways, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds and buildings.

REFUSE. All putrescible and nonputrescible solid wastes (except body wastes), including garbage, rubbish, ashes, street cleanings, dead animals, abandoned automobiles and solid market and industrial wastes.

RUBBISH. Nonputrescible solid wastes consisting of both combustible and noncombustible wastes, such as paper, wrappings, cigarettes, cardboard, tin cans, yard clippings, wood, glass, bedding, crockery and similar materials.

§ 5.13.020 PROHIBITIONS.

(A) No person shall throw, place, scatter or deposit any litter in or upon any public alley, street or highway, or other public place in the city except as authorized elsewhere in this code.

(B) No person shall throw, place, scatter or deposit any litter upon or below the surface of any premises in the city in such a manner that the same is, or may become a nuisance or endanger the public health.

(C) No person shall place or deposit in the city, upon the land of another without permission, any litter.

§ 5.13.030 PENALTY.

Any violation of this chapter is a misdemeanor.
