SEC. 7-701. - DEFINITIONS.

(a) "Assessed value of fixed assets," as used in this article, shall be that amount determined by the Controller as the same amount as the County Assessor would assess such assets if such assets were not owned by a municipal utility.

(b) "Municipal utility" means a municipally owned utility designed in Section 7-702 of this Code.

(c) "Tax rate," as used in this article, means the average rate of the property tax levied upon real and personal property in the city in any fiscal year by all taxing jurisdictions. "Average rate," as used in this subsection, means the weighted average of the total rates levied in all tax areas, as established by the County Assessor within the city, having a total assessed value of one million dollars or more. SEC. 7-702. - MUNICIPAL UTILITIES DESIGNATED.

The municipal utilities of the city are:

(1) The Water Division, an operating division of the Public Works Department.

(2) The Solid Waste Management Division, an operating division of the Public Works Department.

(3) The Parking Division (exclusive of core area parking), an operating division of the Public Works Department. "Core area parking" means the parking facilities, including on-street metered parking places, within Parking Maintenance District No. 1.

(4) The Golf Courses Division, an operating division of the Parks and Recreation Department.

(5) The Sewer Maintenance Division, an operating division of the Public Works Department.

(6) The Waste Water Management Division, an operating division of the Public Works Department.

(7) The Transit Department.

SEC. 7-703. - PAYMENTS BY MUNICIPAL UTILITIES IN LIEU OF TAXES.

During each fiscal year each municipal utility shall pay to the City, in lieu of property and other taxes normally placed upon private business, an amount designated by Council in the Master Fee Resolution. Such amount shall not exceed the amount of such taxes and may include, but shall not be limited to, a sum equal to the product of the assessed value of fixed assets of each municipal utility for the preceding fiscal year multiplied by the tax rate for the preceding fiscal year.
