§ 2.20.010. Created—Director.

There is created a department of public works to be headed by the director of public works. The appointment of the director shall be by the city manager, subject to approval of the city council. The director shall be a registered civil engineer under the laws of the state of California with experience in the construction, design and maintenance of public works systems. Public works should include sewers, storm drains, water supply systems, streets, and the engineering phases of the subdivision of land and all appurtenances thereto. The department shall be responsible for all services and functions related to engineering, planning, design, maintenance, construction and inspection of all public works projects. Public works as defined in this section shall include all city-owned utilities. The director shall perform the duties and exercise the authority provided by law for a city engineer and street superintendent unless such additional positions are authorized by the city council.

The director of public works is hereby given the authority over parks, recreational fields and the city's water department.

§ 2.20.030. Design approval.

The director of public works and city engineer, are authorized to approve designs as to reasonableness on public improvements and other public works projects for which city council approval is not required. Such discretionary authority is hereby delegated to the director of public works and city engineer for the purpose of the design immunity defense provided in Government Code Section 830.6 or successor statute. The approval of design extends to "as built" that are accepted. This delegation is meant to ratify past delegation of such authority.
