§ 2.72.010. Use regulations.

In any instance in which a special event or occurrence such as, but not limited to, the premiere of a motion picture, the opening of a new store, a new building, a bazaar, a wedding, a sports or athletic event, a carnival, a circus, political rally, or any gathering that may attract a large number of people or for other reasons may be, or may become a hazard to the public peace, health, safety or general welfare, unless attended or supervised by the chief of police or the fire chief, as the case may be, or personnel under their respective commands, or in any instance where a person, firm or corporation desires special services over and above the normal services provided by the police department or the fire department of the city, such services, if approved by the chief of police and/or the fire chief, as the case may be, may be provided at the expense of the applicant or person in charge of such event under the conditions listed in this chapter. Such a special event may also require a special event permit in accordance with Chapter 8.50 of this code.

§ 2.72.020. Written request for services.

The person, firm, organization or corporation in charge of such event desiring to employ the services of the city's police or fire personnel to be in attendance thereat, shall file a written request for such services with the chief of police and/or the fire chief, as the case may be. This request shall state the nature of the event, the approximate number of police officers and/or firefighters to be in attendance, the approximate length of time, and a statement agreeing to pay the city for such special services. The applicant shall also deposit, by cash or check, the estimated fee. When the total expense is known, the city will refund any over deposit or bill balance to the person requesting such service.

§ 2.72.030. Approval or denial of request.

The chief of police and/or the fire chief, as may be appropriate, may approve or deny any request.

§ 2.72.040. Payment.

When assigned for duty on such special assignment, police officers or firefighters, as the case may be, shall be deemed to be on regular duty under the general supervision of the chief of police or the fire chief, or any officer in charge under their respective commands, and shall be entitled to any and all benefits provided by law for such personnel as members of the police department or the fire department of the city. The pay for each person thus employed during such assignment shall be at a police officer's or fire officer's regular hourly or overtime pay rate, as applicable. The chief of police or fire chief shall list on the payroll to the fiscal services manager the name of the person, firm, organization or corporation requesting such service, the names of the employees so employed, and the numbers of hours of employment of each. The fiscal services manager shall thereupon compute the charge for the services rendered to the person, firm or corporation employing such personnel at the outside labor rates which are computed and updated semiannually based on existing adjusted labor rates of the position plus benefits. The difference between such amount and that previously deposited by the person requesting such service will be either billed or refunded by the fiscal services manager. A governmental agency is not required to pay an advance deposit.

§ 2.72.050. Failure to pay.

Any failure of said person, firm or corporation billed for services of such personnel to make payment within ten days shall constitute a breach of contract and said person, firm or corporation shall be subject to suit for the debt and shall pay, in addition to said debt, the city's attorney fees and other collection costs.
