Sec. 22-61. - Authority to prescribe additional regulations.

The chief of police is hereby authorized and has the power to formulate rules and regulations for the proper conduct of businesses requiring a permit under this article, or men engaged therein, in addition to the provisions set forth in this article, and any violation of any rules or regulations so formulated shall constitute grounds for the revocation of the permit held by such person.

Sec. 22-62. - Uniforms similar to police uniforms prohibited.

(a)

It shall be unlawful for any person not a regularly employed and duly appointed, qualified and acting member of the police department to wear in the city the prescribed uniform of the members of the police department, or any distinctive part of such uniform, or a uniform any part of which is similar to a

distinctive part of the prescribed uniform of the members of the police department.

(b)

The provisions of subsection (a) of this section shall not be construed so as to prevent persons specifically authorized by the laws of the United States or the state or any municipality or governmental subdivision of the state to wear a prescribed uniform which uniform may be similar to the prescribed uniform of the members of the police department.

Sec. 22-86. - Required.

No person shall engage in or carry on the business of a private patrol system, night watch service, private police system or private detective agency or engage in the business of or be employed as a private patrolman, policeman, detective, investigator, watchman or guard in the city without first having obtained a permit so to do as provided in this division.

Sec. 22-87. - Application; issuance.

(a)

Any person desiring a permit to engage in the business of a private patrol system, night watch service, private police system, detective agency or private patrolman, detective, policeman, investigator, watchman or guard in the city shall file with the license collector an application in triplicate, which application shall contain the full name and address of such person, the territory in which the applicant desires to operate, the address and telephone number of the established place of business, and such other information as may be required.

Upon receipt of such application, the license collector shall refer the application to the chief of police, who shall make a thorough investigation of all facts relative to the application and shall report such findings to the city council, which shall thereupon grant or deny the application. If the chief of police, upon investigation, finds that the person named in such application is a person of good character, honesty and reputation, and is physically and mentally capable of performing the duties of a private patrolman, policeman, detective, investigator, watchman or guard, he shall grant the permit upon the payment of the permit fee provided in this division.

Sec. 22-88. - Fingerprints and photograph required.

Before a permit is granted to any person operating a private patrol system, night watch service, private police system or private detective agency, or to any person desiring to engage in the business of a private patrol, detective, policeman, investigator, watchman or guard, such person shall present to the police department such photographs and fingerprints of the applicant as the chief of police shall request.

Sec. 22-89. - Fee.

Any person desiring to be employed or engaged in the business of a private patrolman, policeman, detective, investigator, watchman or guard shall pay a yearly permit fee in the sum of $5.00, in addition to the requirements otherwise set forth in this division.

No permit issued under this division may be transferred.

Sec. 22-91. - Revocation.

(a)

Business permit. Any permit issued under the terms of this division may be revoked at any time by the city council if the council becomes satisfied that the management, conducting or carrying on of such business does not or will not comport with the public welfare, or that such business has been conducted in an illegal or improper manner or in violation of the rules and regulations laid down by the city council or the chief of police governing the management, conducting or carrying on of such business, or that the manager or person in charge thereof has violated or permitted any infraction of such rules, laws or ordinances. The permit shall not be revoked without first granting to the holder thereof a hearing before the city council.

(b)

Individual permit. The permit of a private patrolman, detective, investigator, policeman, watchman or guard, whether under the employment of a private patrol system or otherwise, may be revoked at any time by the chief of police if he shall be satisfied, after investigation, that such person is not a fit person to carry on such business. Such person may appeal to the council by giving written notice of appeal within ten days from the revocation to the city clerk, and the council may, after hearing thereon, affirm, modify or reverse the revocation.
