Sec. 15-241. - Designation of contracting sponsor.

The city council shall reserve the right to name by contract the sponsor of the annual Fontana Days Celebration with a recognized civic or service-type organization.

Sec. 15-242. - Site selection and preparation.

The contracting organization under this article, with the assistance of the city council's designated jurisdictive departments, shall be responsible for site selection and preparation.

Sec. 15-243. - Presentation of plans; submission of financial statement.

The contracting organization under this article shall be responsible for the general business conduct of putting on the Fontana Days Celebration by annually presenting its plans for the celebration, and upon its completion shall submit a financial statement covering income, expenses and distribution of funds for community betterment to the city council.

Sec. 15-244. - Approval of participants.

All applicants under section 15-246 for a business license or charity solicitation license shall have the prior approval of the contracting organization. The contracting organization shall furnish, upon request of the licensing officer, a list of all approved applicants for a business license or charity solicitation license.

Sec. 15-245. - Parade.

The contracting organization under this article shall be responsible for the arrangement, conduct and securing of required approvals for the annual Fontana Days Celebration parade, and all such fees shall be waived for the contracting organization for the Fontana Days Celebration unless otherwise required by city council action.

Sec. 15-246. - Business license tax on participants.

The contracting organization under this article shall have the exclusive rights to the general conduct of the Fontana Days Celebration at the site ground and on or along the parade route, and shall have full control of the approval of the participants. Should the contracting organization relinquish exclusive control over the participants and formally request that the city council approve the city's participation in the regulation of those participants, the following city business license tax would apply on participants in the Fontana Days Celebration:

At the Fontana Days Celebration site ground:

a.

Carnivals: $150.00 per day plus $500.00 cleanup bond. Under no circumstances shall the employee police department approval application and fee be waived.

b.

Commercial vendors, salespersons or representatives: $15.00 each per day.

c.

Nonprofit organizations: No fee.

d.

Special exhibits, swap meets or other similar activities on or adjacent to the site ground shall pay a business license tax of ten percent of the total dollars' worth of space rented for such activity, plus one percent of the gross, to be paid to the finance director within ten days after the final day of operation.

On or along the parade route:

a.

Peddlers, hucksters, salespersons or vendors: $10.00 each.

b.

Nonprofit organizations: No fee.

Sec. 15-247. - Compliance with applicable regulations.

The contracting organization under this article and participants shall comply with all applicable rules and regulations, and when required by city council action shall pay for permits, bonds, business licenses and insurance.
