Sec. 5-391. - Applicability and scope.

The provisions of this article shall apply to the construction and use of temporary structures, including the use and placement of trailers and commercial coaches, on development sites within the city.

Sec. 5-392. - Exclusions.

The provisions of this article do not apply to the following situations:

(1) Parking of mobile homes in a mobile home park;

(2) Mobile homes placed on residentially zoned lots when such installation has been approved by the planning commission and city council;

(3) Trailers or commercial coaches in nonresidential zones when installation has been specifically approved by the planning commission and city council; or

(4) Temporary buildings, trailers or commercial coaches used in conjunction with public works projects.

Sec. 5-393. - Definitions.

The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Commercial coach means a vehicle with or without motive power, designed and equipped for human occupancy for industrial, professional or commercial purposes.

Mobile home means a structure transportable in one or more sections designed as a dwelling unit.

Mobile home park means an area consisting of approved mobile home lots which are rented or leased to accommodate mobile homes.

Public works means construction, repair or maintenance of public utilities, public streets, public buildings, public parks or any other property owned and operated by a federal, state or local government.

Temporary building means a building moved to a site or constructed on a site for the purpose of temporary use as an office, warehouse, toolshed or shelter for a night watchman. Such building shall not exceed 20 feet in either length or width.

Trailer means a vehicle designed for carrying persons or property on its own structure and for being drawn by a motor vehicle. The word "trailer" includes commercial coaches, boat trailers, travel trailers, mobile homes, campers, house cars and similar vehicles.

Sec. 5-394. - Enforcement; penalty.

(a) It is the duty of the director of building and safety to enforce the provisions of this article, and he or his authorized representative, or the police chief or his authorized representative, may enter upon any premises occupied by any trailer, mobile home, house car, commercial coach or similar vehicle or temporary building for the purpose of making inspections and enforcing the provisions of this article.

(b) Any person violating any of the provisions of this article shall be guilty of an infraction, and upon a first conviction thereof shall be punished by a fine not exceeding $500.00, and for a second conviction within a period of one year shall be punished by a fine not exceeding $1,000.00.

Sec. 5-395. - Permitted use; location.

(a) No temporary building, trailer or commercial coach subject to the provisions of this article shall be placed on any property within the city unless it complies with the terms of this section.

(b) No trailer or commercial coach may be placed nor may any temporary building be erected on any residential subdivision or nonresidential development site for use as an office, warehouse, toolshed or shelter for a night watchman except in connection with a construction project which has been approved by the city, and for which building permits have been issued, with regard to residential subdivision property. Any such temporary building, trailer or commercial coach shall be removed within 24 hours after completion of the project, or, on residential subdivision development sites, within 24 hours of the final inspection of the last dwelling unit in the development project, unless the structure is converted to use as a sales office as set forth in section 5-396.

(c) No temporary building, trailer or commercial coach placed on any residential subdivision or nonresidential development site pursuant to subsection (b) of this section shall be occupied by any person as a dwelling.

(d) Any temporary building, trailer or commercial coach placed on any nonresidential development site pursuant to this section shall be located at least 25 feet from any street intersection, at least 100 feet from any residence, and at least ten feet from any property line not abutting a street or alley.

(e) Any temporary building, trailer or commercial coach placed on any residential subdivision development site pursuant to this section, shall be located at least 25 feet from any street intersection, at least five feet from any existing or proposed property line, including the property line abutting a street, and at least 100 feet from any residence located outside the subdivision boundary.

Sec. 5-396. - Use as sales office.

(a) A temporary structure, trailer or commercial coach may be used fulltime or parttime as a sales office. Such sales office trailer or commercial coach shall be removed when 80 percent of the dwelling units have been sold or by the time six months has lapsed after the final inspection by the city of the last residential unit in the subdivision, whichever occurs first.

(b) A trailer or commercial coach may be used as a sales office for residential multiple developments of four or more abutting dwelling units, provided that the trailer is located within the boundaries of the residential development being constructed, and provided further that the trailer or commercial coach complies with all applicable codes and ordinances.
