§ 11-15. California Fire Code.

  • (a) The 2025 California Fire Code, California Code of Regulations Title 24, Part 9, including Appendix Chapters 4, B, C, and D (Sections D102, D103.6, D103.6.1, D103.6.2 only), I, and N as published by the International Code Council is adopted by the City of Escondido.

  • (b) The 2025 Wildland-Urban Interface Code, California Code of Regulations Title 24, Part 7, as published by the International Code Council, is adopted by the City of Escondido.

§ 11-16. Local amendments.[2 ]

§ 11-17. Definitions in fire code.

Wherever the following words and phrases are used in the Uniform Fire Code adopted by this article, they shall have the meanings ascribed to them in this section.

"Board of appeals" shall mean the building advisory appeals board of the city.

"Chief of the bureau of fire prevention" shall mean the fire marshal.

"Corporation counsel" shall mean the city attorney.

"Municipality" shall mean the City of Escondido.

§ 11-18. Conflicts.

In event that there is a conflict between the provisions of the Uniform Fire Code adopted by this article and any express provision of the Code of Ordinances, the express provision of the Code of Ordinances shall prevail.

§ 11-19. Penalties for code violation.

  • (a) Any person, firm or corporation, whether as principal, agent, employee, or otherwise, who shall violate any of the provisions of this chapter or the code adopted by this article, or fail to comply therewith, or who shall violate or fail to comply with any order made thereunder, or who shall build in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder, and from which no

appeal has been taken, or who shall fail to comply with such an order as affirmed or modified by the building advisory appeals board of the city or by a court of competent jurisdiction, within the time fixed herein, shall severally for each and every such violation and noncompliance respectively be guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than $500 or by imprisonment for term not exceeding six months, or by both such fine and imprisonment.

  • (b) The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.

§ 11-20. Appeals.

Whenever the chief of the fire department shall disapprove an application or refuse to grant a permit applied for, or when it is claimed that the provisions of the adopted technical codes do not apply or that the true intent and meaning of the code have been misconstrued or wrongly interpreted, the applicant may appeal the decision to the building advisory appeals board. The appeal must be initiated within 10 days from the act, decision or interpretation which is the subject of the appeal.

§ 11-21. Wildland-Urban Interface Fire Severity Zones.

The City of Escondido Fire Severity Zones map, as shown in Figure 11-21, identifies the areas of moderate, high, and very high danger of fire hazard.

§ 11-29. Committee designated to determine new materials, processes, occupancies which…

The building director, the chief of the fire department and chief of the bureau of the fire prevention shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits, in addition to those now enumerated in the uniform fire code. The fire chief of the bureau of fire prevention shall post such list in a conspicuous place in his office, and distribute copies thereof to interested persons.
