Article 5 — ENFORCEMENT

Whenever the County Assessor, the head of any City department, or other City official, finds that the provisions of this chapter or of the Map Act have been violated, said official shall report the violation to the Director of Planning and Building. It shall be the duty of the Director of Planning and Building to investigate the report and enforce the provisions of this chapter and the Map Act. (Ord. 96-26, § 1, Exh. A, 9-11-96)

Notice of Violation

Whenever the Director of Planning and Building has knowledge that real property has been divided in violation of the provisions of the Map Act, this chapter, or any other city ordinances, the Director of Planning and Building shall file a notice of intent to record a notice of violation with the County Recorder, in accordance with the provisions of Section 66499.36 of the Map Act.

Development Permits and Approvals Withheld

If the Director of Planning and Building, or on appeal, the Planning Commission or City Council, finds that any real property has been divided, or has resulted from a division, in violation of the provisions of the Map Act, this chapter, or any other City ordinance, then no permits or approvals of any kind necessary to develop the property shall be issued, pursuant to Section 66499.34 of the Map Act.

Any deed of conveyance, sale or contract to sell real property which has been divided, or which has resulted from a division in violation of the provisions of the Map Act, this chapter or any other City ordinance is voidable in accordance with the provisions of Section 66499.32 of the Map Act.

32.505 Violations

Any person violating any of the provisions of this chapter shall be guilty of a misdemeanor in accordance with Chapter 7, Article 1 (beginning with Section 66499.30) of the Map Act. (Ord. 96-26, § 1, Exh. A, 9-11-96)
