§ 2.34.010. Planning Commission Established.¶
The Planning Commission of the City of Encinitas is hereby established.

§ 2.34.020. Membership.¶
A. The Planning Commission shall consist of five members; each Commissioner shall be appointed to one of the following positions:
Cardiff-by-the-Sea position.
Leucadia position.
New Encinitas position.
Old Encinitas position.
Olivenhain position.
B. Each Commissioner shall be a registered voter of the City and shall maintain residency and voter registration in the geographic area designated for the position to which the Commissioner is appointed.
C. To be qualified for appointment, a person shall have resided as a registered voter, for a period of no less than six months prior to appointment, in the geographic area designated for the position for which appointment is sought.
D. The affirmative votes of three Council Members shall be required to appoint an individual to the Planning Commission.
E. Planning Commissioners shall serve staggered, three-year terms.

§ 2.34.030. Meetings.¶
A. Three members of the Planning Commission shall constitute a quorum.
B. The regular meetings of the Planning Commission shall be two each month.
C. The Planning Commission shall elect a chairperson and a vice chairperson from among its members for one-year terms.

§ 2.34.040. Duties of Planning Commission.¶
A. The Planning Commission shall perform such duties as may be specified by ordinance or resolution of the City Council or by the laws of the State of California. Further, the Planning Commission shall study and report to the City Council upon any matter referred to it by the City Council and shall keep the City Council currently advised of all matters pending, and shall furnish any special information, reports or materials which the City Council may request.
B. The Planning Commission shall make a final determination as authorized by this Code for the following applications:
Coastal development;
Conditional use permit (major);
Tentative tract map;
Zoning Code interpretation;
Application for project in more than one community planning area;
Other applications and duties as required by this Code.
C. The Planning Commission shall make recommendation to the City Council as authorized by this Code for the following applications:
General Plan interpretation;
General Plan amendment;
Zoning Code amendment;
Zoning Map amendment;
Specific plan;
Other applications as required by this Code.

§ 2.34.060. Appeal of Planning Commission Decision.¶
All decisions of the Planning Commission shall be posted at City Hall and shall become final unless appealed in accordance with Chapter 1.12.
