14-4-1: PURPOSE:

The purpose of this Chapter is to provide a procedure by which the size or configuration of two (2) or more existing parcels may be adjusted, provided:

A. Land taken from one parcel is added to an adjacent parcel;

B. A greater number of parcels than originally existed is not created; and

C. The adjustment is approved by the Director of Community Development. (Ord. 1212, 11-16-1993; amd. Ord. 1315, 1-18-2000; Ord. 1639, 9-20-2022)

14-4-2: FILING PROCEDURES AND DOCUMENTATION:

A. Filing Request: All requests for a lot line adjustment shall be filed with the Director of Community Development on an approved City application form.

B. Filing Documentation: A lot line adjustment request shall include the required number of copies of the following materials:

    1. Grant deeds and/or title report for all properties;
    1. A legal description of each existing and new lot/parcel to be created;
    1. A plat map or maps displaying each existing and new lot or parcel;
    1. City application forms; and

14-4-3: PROCESSING PROCEDURES:

A. Lot Line Adjustment Request: Once an application has been deemed acceptable for filing, the Director of Community Development shall distribute the lot line adjustment request for review and comment to all other appropriate City departments. (Ord. 1245, 2-6-1996; amd. Ord. 1315, 1-18-2000)

B. Decision Of Director: Within thirty (30) days of accepting the application as complete, the Director of Community Development shall approve, approve with conditions or disapprove the lot line adjustment.

C. Certificate Of Compliance: Upon approval or conditional approval of the lot line adjustment, the Director of Community Development shall issue a certificate of compliance indicating the City's acceptance and approval of the request.

D. Grant Deed: The applicant shall have a new grant deed recorded which reflects the approved lot line adjustment and provide the City with a copy.

E. Record Of Survey: A record of survey shall not be required for a lot line adjustment unless required by section 8762 of the California Business and Professions Code. (Ord. 1212, 11-16-1993; amd. Ord. 1315, 1-18-2000; Ord. 1639, 9-20-2022)

14-4-4: EVALUATION CRITERIA:

The evaluation of a lot line adjustment shall be limited to determining whether or not the new lot or parcel created conforms to existing zoning and building codes. (Ord. 1212, 11-16-1993)

14-4-5: CONDITIONS OF APPROVAL:

A. Conditions: The Director of Community Development shall not impose conditions or exactions on the approval of a lot line adjustment, except:

  1. To conform to local ordinances.

  2. To facilitate the relocation of existing utilities, infrastructure, or easements.

B. Maps: No tentative map, parcel map, or final map shall be required as a condition to the approval of a lot line adjustment. (Ord. 1212, 11-16-1993; amd. Ord. 1315, 1-18-2000; Ord. 1639, 9-20-2022)

14-4-6: APPEALS:

All appeals shall be processed as provided by Title 15, Chapter 25 of this Code. (Ord. 1212, 11-16-1993)
