Sec. 5.20.010. - Authorized organizations.¶
Organizations exempted from the payment of the bank and corporation tax by Revenue and Taxation Code §§ 23701a, 23701b, 23701(d), 23701e, 23701f, 23701g, 23701k, 23701(l) and 23701w and a contribution or gift to which would be a charitable contribution under Section 170(c)(2) of the Internal Revenue Code of 1954, or by mobile home park associations and senior citizens organizations, and school districts, provided that the proceeds of such games are used solely for charitable purposes, may hold bingo games under the conditions set forth in this chapter.

Sec. 5.20.020. - Bingo defined.¶
As used in this chapter, the term "bingo" has the meaning set forth in Penal Code § 326.5(o) as it now exists or may hereafter be amended.

Sec. 5.20.030. - License required.¶
An annual license must be first obtained from the County Tax Collector for a fee set from time to time by the County Board of Supervisors.

Sec. 5.20.040. - Individual profit prohibited.¶
It is a misdemeanor for any person to receive a profit, wage or salary from any bingo game authorized by Section 19 of Article IV of the California Constitution.

Sec. 5.20.050. - Penalty for violation of Section 5.20.040.¶
A violation of Section 5.20.040 shall be punishable by a fine pursuant to State law, which fine shall be deposited in the general fund of the County which enacted the ordinance authorizing the bingo game.

Sec. 5.20.060. - Enjoining violation.¶
The County may bring an action to enjoin a violation of this chapter.

Sec. 5.20.070. - Minor participation prohibited.¶
No persons under 18 years of age shall be allowed to participate in any bingo game.

Sec. 5.20.080. - Property to be used.¶
A nonprofit, charitable organization shall conduct a bingo game only on property owned or leased by it for general purposes of the organization.

Sec. 5.20.090. - Open to public.¶
All bingo games shall be open to the public.

Sec. 5.20.100. - Operation.¶
A bingo game shall be operated and staffed only by members of the nonprofit charitable organization which organized it. The members shall not receive a profit, wage or salary from any bingo game. Only the organization authorized to conduct a bingo game shall operate the game or participate in the promotion, supervision or any other phase of the game.

Sec. 5.20.110. - Financial interest restricted.¶
No individual, corporation, partnership or other legal entity except the organization authorized to conduct a bingo game shall hold a financial interest in the conduct of the bingo game.

Sec. 5.20.120. - Accounting.¶
All profits derived from a bingo game shall be kept in a special fund or account and shall not be commingled with any other fund or account.

Sec. 5.20.130. - Physical presence to participate.¶
No person shall be allowed to participate in a bingo game unless the person is physically present at the time and place in which the bingo game is being conducted.

Sec. 5.20.140. - Amount of prizes.¶
The total value of prizes awarded during the conduct of any bingo games shall not exceed $500.00 in cash or kind or both for each separate game which is held.
