Chapter 10.28 — MOTOR VEHICLES ON PRIVATE PROPERTY

Sec. 10.28.010. - Written permission.

A.

No person shall drive a motor vehicle upon real property which is, or is immediately adjacent to, residential property, or enclosed by fence, or under cultivation, or posted with signs forbidding trespassing, and which belongs to, or is lawfully occupied by another, after having been warned to keep off of or keep away from the property, either by posted sign or otherwise, without having in their immediate possession written permission to operate the vehicle on such property from the owner of such property, or his or her agent, or the person in lawful possession thereof; provided, however, that this section shall not apply to persons having visible or lawful business with the owner, agent or person in lawful possession.

B.

For the purposes of this section, real property shall be considered property posted with signs forbidding trespassing if signs are displayed at intervals of not less than three to a mile, along all exterior boundaries and at all roads and trails entering the property.

Sec. 10.28.020. - Display of permission.

The written permission from the owner, agent or persons in lawful possession of the property shall be displayed or furnished to a peace officer upon request.

Sec. 10.28.030. - Contents of written permission.

The written permission shall contain the name of the person to whom permission to operate the motor vehicle is given, the dates and time of intended use, the address and/or phone number where the owner, agent or person in lawful possession may be reached, and the signature of the owner, agent or person in lawful possession.

Sec. 10.28.040. - Punishment.

Any person in violation of this chapter shall be guilty of a misdemeanor and subject to punishment according to the general penalties described in Chapter 1.24. To the extent violation of this chapter also constitutes a violation of other State or County

laws, such violations shall carry the applicable fine and/or punishment.
