6.60.010 - Provisions supplementary to state law.

The provisions of this chapter, allowing bingo games, are not intended to conflict with, but shall supplement, all laws relating to lotteries, gaming or gambling.

6.60.020 - Penal Code sections incorporated.

The provisions of the state Penal Code 4 concerning bingo games are incorporated in this chapter by reference, and "approved organization" in this chapter means an organization referred to therein.

6.60.030 - License required.

A. No approved organization shall conduct a bingo game without a valid license obtained pursuant to the provisions of this chapter.

B. No person shall promote, supervise, operate, conduct or staff any bingo game unless such person is a member of an approved organization which is lawfully licensed to do so, and which has designated such person to do so.

6.60.040 - Application.

A. The application for a license to conduct bingo games shall be made in the manner specified in Chapter 6.05 of this title. The police chief is the public official who will conduct the investigation.

B. The application shall include the following information, in addition to that specified in Chapter 6.05:

  1. The name, address, date and place of birth, physical description, and driver's license number or state Department of Motor Vehicles identification card number of every officer of the approved organization;

  2. The name, address, date and place of birth, physical description, and driver's license number or state Department of Motor Vehicles identification card number of those persons to be authorized to operate bingo games on behalf of the organization;

  3. The date(s) and location(s) of each proposed bingo game;

  4. Proof that the organization is an approved organization as defined by the state Penal Code.

6.60.050 - Notice of intent and show-cause hearing.

If the police chief determines that a bingo game license should be suspended or revoked, he shall serve on the licensee a notice of his intent with his reasons for such determination. The notice shall provide for suspension or revocation of the license seven days after service of the notice upon the licensee, unless the licensee arranges to appear at a hearing before the police chief and show cause why such action should not be taken.

6.60.060 - Summary suspension or revocation.

A. The police chief may immediately seize, suspend or revoke a bingo game license upon a licensee's refusal to:

  1. Permit the entry of any police officer to investigate the conduct of a bingo game; or

  2. Permit the police chief to review or audit the approved organization's records relating to the conduct of bingo games under the license and to the special account required by state Penal Code Section 326.5(j).

B. The suspension or revocation, and any subsequent appeal, will be done in the manner specified in Chapter 6.10 of this title.

6.60.070 - License not transferable.

Each license shall be issued to a specific approved organization; it authorizes such organization to conduct a bingo game on its behalf at one or more named locations. Such license is not transferable, and any attempt to transfer, assign, pledge or mortgage the license or to attach or execute on it immediately and permanently voids it. The license is only a temporary permit to act within the provisions of all laws. A license has no validity when it has been seized, suspended or revoked by the police chief.

6.60.080 - License displayed.

The license shall be prominently displayed at the authorized location or locations during playing of all bingo games.

6.60.090 - Hours.

No bingo game shall be conducted between the hours of two a.m. and nine a.m.

6.60.100 - Consent.

The application for or acceptance of a license constitutes:

A. Consent to the entry of any police officer(s) to investigate a location(s) identified in the application, before the issuance of a license, as well as during any bingo game(s) played thereafter.

B. Consent for a review or audit by the police chief of the approved organization's records relating to the conduct of bingo games and to the special account required by state Penal Code for the purpose of verifying compliance with all laws.
