El Cerrito Municipal Code Ch. 2.20 Public Officials

Various city officials, described in this chapter, are named in state law. These officials are appointed by and responsible to the city manager. The specific line responsibilities and assignments of these officials shall be determined by the city manager unless otherwise defined in this code. Qualified consultants or consulting firms may be appointed to fulfil the obligations of any of the public officials. A single public official may fill one or more of the offices described in this chapter.

The position of city treasurer is created. The city treasurer shall perform such duties as are required by law as well as those assigned by the city manager.

The position of license and permits administrator is created. The license and permits administrator shall administer the business license tax, and other licenses and permits, and perform such duties as are assigned by the city manager.

The position of police chief is created. The police chief shall exercise such powers and perform such duties as are prescribed by law as well as those assigned by the city manager.

The position of fire chief is created. The fire chief shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of health officer is created. The health officer shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager. The powers and duties of the health officer shall be executed by the county health officer.

The position of director of public works is created. The director of public works shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of city engineer is created. The city engineer shall be a state licensed professional civil engineer. The city engineer is responsible for approving the design of all public structures, for evaluating bids for construction or maintenance of public facilities, and for giving professional engineering advice to the council. The city engineer shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of building official is created. The building official is responsible for receiving and reviewing building plans submitted to the city for review. The building official shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of superintendent of streets is created. The superintendent of streets is responsible for maintaining records on the condition of the boulevards, streets, walkways and sidewalks within the city. He shall provide advice on their maintenance requirements, and supervise their construction and maintenance. The superintendent of streets shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of director of community services is created. The director of community services shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of director of parks and recreation is created. The director of parks and recreation shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

The position of planning director is created. The planning director shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

Pursuant to Sections 37209 and 40805.5 of the State Government Code, the position of director of finance is created. The accounting and finance duties of the city clerk shall be and are transferred to the director of finance. The director of finance shall exercise such powers and duties as are prescribed by law as well as those assigned by the city manager.

All demands upon the city treasury, when properly audited and approved pursuant to applicable ordinances and resolutions, shall be paid.

The director of finance may execute warrants and checks with a facsimile signature in lieu of his manual signature. This section shall not apply to any public security or other instrument where a manual signature is otherwise required by law.

The position of city clerk is created. The city clerk shall work under the direction of the city manager and perform such duties as are required by law.
