Sec. 20.01.010. - Application of title.

(a)

The provisions of this title shall apply to and be in full force and effect at all park and recreation areas owned or operated by the city. The provisions of this title shall govern the use of all such parks and recreation, areas and compliance with the provisions of this title shall be a condition under which the public may use such parks and recreation areas.

(b)

The provisions of this title shall not apply to any city officer or employee who is acting in the course of and within the scope of city business.

Sec. 20.01.020. - Definitions.

For the purpose of this title, the words and phrases set out in this section shall apply:

Alcoholic beverage means alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol, spirits, wine, or beer, and which contains one-half of 1 percent or more of alcohol by volume and which is fit for beverage purposes either alone or when diluted, mixed, or combined with other substances.

Amplified sound means music, sound wave, vibration or speech projected or transmitted by electronic equipment, including but not limited to amplifiers.

Animal means any living thing that is a member of the animal kingdom, other than a human being.

Approved special event means a special event in a park authorized by a city-issued temporary event permit.

Chief of police is the chief of police of the city or designee per agreement with the Riverside County Sheriff Department.

City is the city of Eastvale.

City manager is the city manager of the city, or designee.

Director means the director of Community Services and Recreation, or any other person authorized by him/her, pursuant to law, to act in his or her stead.

Fire chief is the chief of the fire department of the city or designee per agreement with Riverside County.

Foil balloon means any balloon constructed of electrically conductive material, including foil, metallic foil, Mylar, or other transparent plastic/polyester resin designed to be inflated with air or other gas including a gas lighter than air causing it to float, and may be used for decorative, toy, or entertainment purposes.

Gas lighter than air means a gas that has a lower density than normal atmospheric gases and rises above them as a result, including, but not limited to, helium, hydrogen, nitrous oxide, methane, and nitrogen.

Park means any park, playground, athletic facilities, recreation area or center, or any other area or structure maintained and operated by the city.

Permit or reservation means written authorization for exclusive, or semi-exclusive use of parks or buildings or portions thereof, as provided for and defined in this title.

Person is any person, firm, partnership, association, group, corporation, company or organization of any kind.

Special event means any event to which the public is invited, with or without charge, including but not limited to music festivals, stage and/or theatrical shows, sports events, fairs and/or carnivals, rodeos, automobile sales, off-road vehicle sales, animal sales, heavy equipment auctions and tent revival meetings.

Vehicle means any device by which any person or property may be propelled, moved or drawn, excepting a device moved by human power.

Sec. 20.01.030. - Authority to close park.

(a)

In an emergency or when the city manager, chief of police, or director (or an appropriately designated representative of any such official) shall determine that the public health or safety demands such action, any park, or any portion thereof, may be closed to the public and all persons may be excluded therefrom until such emergency or other reason upon which determination of the city manager, chief of police or the director is based has ceased, and upon the cessation thereof the park, or portion thereof, so closed shall again be reopened to the public by order of proper authority.

No person having knowledge of or having been advised of any closure order issued pursuant to subsection A of this section shall refuse or fail to immediately to remove themself from the park, or portion thereof, so closed, and no such person shall enter or remain within any such area until such area or place has been reopened to the public by order of the proper authority.

Sec. 20.01.040. - Violation-penalty.

It is unlawful for any person to violate any provision or fail to comply with any of the requirements of this title. Any person violating any provision of this title or failing to comply with any of the requirements is deemed guilty of a misdemeanor as provided in section 1.01.220 of this code.
