9.04.010 - Areas where loitering for unlawful purposes is prohibited.

The areas within which Section 9.04.020 of this chapter may be enforced are the public streets, sidewalks, parks, parking lots, alleys, and walkways within the following geographic limits of the city;

  1. Dunsmuir Avenue extending from the north side of Spruce Street to the south side of Oak Street;

  2. The municipal parking lot on the east side of Dunsmuir Avenue lying to the north of Spruce Street;

  3. Pine Street extending from the west side of Castle Avenue to the east side of Sacramento Avenue;

  4. Sacramento Avenue extending from the north side of Willow Street to the south side of Oak Street;

  5. The city park facility located at 4835 Dunsmuir Avenue, and the Hedge Creek Falls Park located at 4111 Dunsmuir Avenue.

9.04.020 - Loitering for unlawful purposes.

Within the areas designated in Section 9.04.010, it is unlawful for any person to loiter for the purpose of engaging in any of the unlawful acts enumerated in Section 9.04.030.

9.04.030 - Unlawful acts.

For purposes of Section 9.04.020, "unlawful acts" means any unlawful act or conduct as set forth in the following provisions of state law:

A. Penal Code Section 272 (Contributing to the delinquency of a minor);

B. Penalty Code Section 303a (Begging or soliciting customer to purchase alcoholic beverage);

C. Penal Code Section 308 (Furnishing tobacco or smoking paraphernalia to a minor);

D. Penal Code Section 415 (Disturbing the peace);

E. Penal Code Section 594 (Vandalism);

F. Penal Code Sections 647(a), (b), (c), (e), and (f) (Disorderly conduct—solicit lewd conduct, solicit prostitution, panhandling, no purpose and refuse I.D., intoxicated and unsafe);

G. Penal Code Section 602.1 (Blocking public access to a place of business);

H. Health and Safety Code Sections 11000 through 11651 (Offenses and Penalties—Uniform Controlled Substances Act).

9.04.040 - Violation—Penalty.

Any person convicted of violating this chapter shall be guilty of an infraction. The punishment upon a conviction shall be a fine as set forth in California Government Code Section 36900(b). This amount is currently not exceeding one hundred dollars ($100.00) for a first violation of the same ordinance within one year, and not exceed two hundred dollars ($200.00) for a second violation of the same ordinance within one year, and not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance within one year.
