Editor's note— Ord. No. 2024-1346, §§ 1, 2, adopted April 2, 2024, repealed the former Ch. 1.12, § 1.12.010, and enacted a new Ch. 1.12 as set out herein. The former Ch. 1.12 pertained to city seal and derived from Ord 1 §1, adopted 1915.

1.12.010 - Adoption of city seal.

Pursuant to Government Code § 34501, the city council approves and adopts the following seal as the city seal, with lettering, form, arrangement, and designs all as set forth in the embossed or stamped impression thereof which follows:

1.12.020 - Adoption of city logo.

The city council approves and adopts the following logo as the city logo, with lettering, form, arrangement, and designs all as set forth in the embossed or stamped impression thereof which follows:

1.12.030 - Custody and use.

The city clerk shall have the custody of the City of Delano City seal and city logo. The use of the city seal or city logo shall be for purposes directly connected with official business of the city. No person or group shall use the city seal or city logo without first obtaining the prior consent of the city clerk as provided in this section.

1.12.040 - Authorization for use.

The city clerk is empowered to authorize individuals or groups to use the city seal or city logo, provided the use has been approved in advance by the city council. This includes authorizing use of the city seal or city logo in conjunction offered for sale by the city, for the purpose of promoting the city. Prior to authorizing such use, the city clerk shall obtain a plan describing the items that would bear the city seal or city logo. the plan shall include the criteria used in determining the proposed items and analysis of the marketability of each item. Only those items bearing the city seal or city logo that have been authorized by the city council pursuant to this section may be offered for sale.

1.12.050 - City council use.

Currently seated council members may use the city seal or city logo for non-commercial and non-political ceremonial purposes such as congratulating individuals on significant anniversaries, birthdays, local sports teams and similar type events.

1.12.050 - Penalties.

Every person who, without the prior approval of the city council, uses or allows to be used the city seal or city logo or any copy or reproduction of either, without authority granted by the city council, whether for commercial, personal, or any manner whatsoever not consistent with this Chapter 1.12 or state law, is guilty of a misdemeanor.
