23.05.010 - Purpose.¶
It is the purpose of this Chapter to establish a review process for construction plans before erection, construction, enlargement, alteration, repair, movement, improvement, removal, conversion, demolition, equipping, using, occupying or maintaining of any building or structure within the City. The intent is to determine compliance with applicable codes and other regulations to safeguard public health, safety, and welfare.

23.05.020 - Types of Construction Permits.¶
The following permits require building review, and the procedures for building permits apply to these permits unless stated otherwise in this Chapter: Building Permits, Electrical Permits, Plumbing Permits, and Mechanical Permits.

23.05.030 - Building Permits.¶
The purpose of this Section is to establish the process for review of Building Permit applications for compliance with the minimum standards necessary to safeguard life or limb, public health, property, and welfare. The intent of these procedures is to review the proposed design, construction methods, and type and quality of materials used for new construction or for construction involving existing structures.
A. When a Building Permit Is Required:
No structure shall be erected, constructed, enlarged, altered, repaired, improved, converted, permanently relocated or partially demolished unless a Building Permit has first been obtained, or the construction otherwise meets an exemption per the California Building Code or Title 23 (Building Construction).
Separate Building Permits are not required for a dwelling and associated accessory structures located on the same property and described in the Building Permit application, plot plan, and other drawings.
No building permit shall be issued relating to a structure for which a Design Review Permit is required until the Design Review Permit is obtained.
B. Issuance of a Building Permit:
A Building Permit is a ministerial approval type that may be issued at the staff level if all applicable code requirements have been met.
In addition to plan check approvals, other documentation may be required before the permit is issued, in conformance with the requirements of the Del Mar Municipal Code or the laws or requirements of other applicable local, state, or federal jurisdictions.
The Building Permit may be issued after all approvals have been obtained and the required fees have been paid.
C. Expiration of a Building Permit:
A Building Permit issued in a Residential Zone shall expire two years after the date of permit issuance.
A Building Permit issued in a Commercial Zone or within a Specific Plan Zone shall expire four years after the date of permit issuance.
All Electrical, Plumbing, or Mechanical Permits associated with a Building Permit shall expire concurrently with the Building Permit.
If the building or work authorized by a Building Permit has not received final inspection approval prior to the permit expiration date, all work shall stop until either a new permit is issued, or the date of expiration for the Building Permit is extended in accordance with Section 23.05.030(D).
D. Request to Extend the Date of Expiration for a Building Permit:
A permit holder may submit an application to extend the date of expiration for a Building Permit.
A decision to extend the expiration date for a Building Permit shall be made by the Building Official in accordance with the following:
a. For an application that is filed at least 30 calendar days prior to the date of Building Permit expiration, the Building Official shall automatically issue one or more extensions of time, with each extension no longer than 180 days per extension, for a total extension period not to exceed two years after the initial date of expiration.
b. For an application that is filed less than 30 calendar days from the date of Building Permit expiration, the Building Official shall automatically grant an extension for a period of 60 calendar days from the date of expiration. The Building Official may then grant one or more extensions of time, with each extension no longer than 180 days per extension, for a total extension period not to exceed two years after the initial date of expiration, if the Building Official determines that all of the following apply:
i. There has not been a significant change in any public health and safety regulations applicable to the site since the date the permit was issued;
ii. The additional time extension is in the public interest; and
iii. Circumstances beyond the control of the applicant prevented the authorized work from proceeding.
Any Electrical, Plumbing, and Mechanical Permits associated with a Building Permit shall automatically be extended concurrent with the Building Permit.
If no extension is granted, a new Building Permit shall be required.

23.05.040 - Electrical Permits, Plumbing Permits, and Mechanical Permits.¶
The purpose of this Section is to establish the process for review of applications for Electrical Permits, Plumbing Permits, and Mechanical Permits for compliance with the minimum standards necessary to safeguard life or limb, public health, property, and welfare.
A. When an Electrical Permit, Plumbing Permit, and Mechanical Permit Is Required:
No electrical wiring, device, appliance, or equipment shall be installed within or on any structure or premises nor shall any alteration, addition, or replacement be made in any existing wiring, device, appliance, or equipment unless an Electrical Permit has been obtained for the work.
No plumbing system, or portion of a plumbing system, shall be installed within or on any structure or premises, nor shall any alteration, addition, or replacement be made in any existing plumbing system unless a Plumbing Permit has been obtained for the work.
No heating, ventilating, air conditioning, or refrigeration system or part thereof shall be installed, altered, replaced, or repaired unless a Mechanical Permit has been obtained for the work.
An Electrical Permit, Plumbing Permit, and Mechanical Permit shall be exempt from obtaining a permit if the scope of work meets an exemption in the California Building Code, California Electrical Code, California Plumbing Code, or California Mechanical Code.
B. Issuance of an Electrical Permit, Plumbing Permit, and Mechanical Permit:
Electrical Permits, Plumbing Permits, and Mechanical Permits are ministerial approval types that may be issued at the staff level if all applicable code requirements have been met.
An Electrical Permit, Plumbing Permit, and Mechanical Permit may be issued after all approvals have been obtained and the required fees have been paid.
An Electrical Permit, Plumbing Permit, and Mechanical Permit shall not be issued for a development that requires a development permit until the development permit has been issued.
C. Expiration of an Electrical Permit, Plumbing Permit, and Mechanical Permit:
An Electrical Permit, Plumbing Permit, and Mechanical Permit shall expire two years after the date of permit issuance if the work authorized by the Electrical Permit, Plumbing Permit, and Mechanical Permit has not received final inspection approval by the permit expiration date.
If the work authorized by the Electrical Permit, Plumbing Permit, and Mechanical Permit has not received final inspection approval by the permit expiration date, all work shall stop until a new permit is issued.
Any Electrical Permit, Plumbing Permit, and Mechanical Permit associated with a Building Permit shall expire concurrently with the Building Permit.
An expired Electrical Permit, Plumbing Permit, and Mechanical Permit may be extended by the Building Official concurrently with the extension of a Building Permit.
A new Electrical Permit is required to finish any work that was not finished because of the expiration of the permit; however, unfinished work may be removed without a permit
