§ 10.14.010. Findings and Determinations.

The Council finds and determines that:

(a) The designation of the City of Dana Point as a bird sanctuary will be beneficial to the community in that the protection of birds will afford varied and changing opportunities for the observation of one of nature's interesting species for present and future generations; and

(b) That the presence and health of a varied bird population contributes to the benefit and enjoyment of Dana Point's natural environment.

§ 10.14.020. Dana Point a Bird Sanctuary.

The City is hereby established and designated as a bird sanctuary.

§ 10.14.030. Molesting Birds Prohibited.

No person shall trap, hunt, shoot, molest, injure, or kill any bird or damage, destroy, or otherwise tamper with the nests or eggs of any wild bird within the geographical boundaries of the City. Birds not protected under this chapter include rock doves (pigeons), European starlings, and house sparrows. Any violation of this chapter shall be illegal and shall constitute a misdemeanor which may be punished in accordance with Section 1.01.200 of the Dana Point Municipal Code.

§ 10.14.040. Nuisances—Remedies.

Should the Council find and determine by Resolution that certain birds protected under this chapter have become so numerous or destructive in a particular area so as to constitute a menace and danger to the public health and safety, the Council may provide for such remedies as may be deemed appropriate under the circumstances.
