Cypress Municipal Code § 16-73 Oversized vehicles; overnight parking—Definitions

For the purposes of sections 16-73.1—16-73.3, the following words, terms, and phrases shall have the meanings ascribed to them herein unless the context clearly indicates otherwise:
(a) Nonmotorized vehicle. A "nonmotorized vehicle" is any vehicle, camp trailer, semi-trailer, or trailer coach as defined by the Vehicle Code.
(b) Oversized vehicle. An "oversized vehicle" is any vehicle or combination of vehicles that exceeds eight feet high or 22 feet in length or 92 inches in width exclusive of projecting lights or devices as allowed by Sections 35109, 35110 or 35112 of the Vehicle Code as may be amended.
(c) Commercial vehicle. A "commercial vehicle" is any vehicle of a type required to be registered under the Vehicle Code used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of property.

Editor's note: Section 1 of Ord. No. 891, adopted Nov. 23, 1992, repealed § 16-73 in its entirety. Formerly, § 16-73 pertained to wide vehicle and trailer parking restricted during hours of darkness and derived from § 2 of Ord. No. 364 and Ord. No. 440, adopted Nov. 9, 1970. Section 2 of Ord. No. 891 provided further for the addition of a new § 16-73 as herein set out.
§ 16-73.1. Same—Overnight parking.¶
(a) No person shall park or leave standing upon any public street or highway any oversized vehicle or nonmotorized vehicle at any time between the hours of 2:00 a.m. and 6:00 a.m.
(b) No person shall park or leave standing any commercial vehicle that exceeds eight feet high or 22 feet in length or 92 inches in width between the hours of 2:00 a.m. and 6:00 a.m. upon any public street or high-way.
(c) Exception. The provisions of section 16-73.1(a) shall not apply to the following:
(1) Any oversized vehicle displaying a valid permit issued by the chief of police or his designee in accordance with the special circumstances set forth in subsection (d) of this section.

(d) Permits. The chief of police or his designee may issue a temporary permit for the overnight parking of only an oversized vehicle if he makes any of the findings set forth in this section. Such permit shall be valid for the time period stated thereon and shall be issued only in the event of special circumstances which shall include the following:
(1) The vehicle belongs to visitors or house guests temporarily residing in the city. Such permit shall be valid for a maximum period of seven days and will not be issued to vehicles registered to a residence in the city.
(2) The vehicle belongs to a new resident, or is newly purchased, and suitable permanent parking or storage is being arranged. Such permit shall be valid for a maximum period of 30 days.
(3) The vehicle is used as the sole means of transportation and the parking of such vehicle is not reasonably possible on the owner's premises. Such permit shall be valid for a maximum period of 12 months and may be renewed for successive twelve-month periods. The owner is required to provide documentation showing the vehicle is their primary means of transportation.
(4) The vehicle is parked for the purpose of loading or unloading such vehicle. Such permit shall be valid for a maximum period of 24 hours. However, in no event shall this permit be issued to a commercial vehicle.

§ 16-73.2. Same—Signing.¶
Pursuant to Vehicle Code Section 22507, signs giving adequate notice of the prohibitions contained in this section shall be placed within city limits of the City of Cypress.

§ 16-73.3. Same—Penalty.¶
Violation of the provisions of sections 16-73.1 and 16-73.2 shall be an infraction subject to the issuance of a citation and shall be punishable by a fine of $25. Each day a violation is committed shall be considered a separate offense subject to the issuance of a separate citation. Pursuant to Section 22651 of the Vehicle Code, any nonmotorized vehicle or oversized vehicle parked or left standing on a public street or highway in violation of the provisions of sections 16-73.1 and 16-73.2 may be removed from the street or highway upon which such vehicle is parked or left standing.
