Chapter 17.62 — COASTAL ZONE ADMINISTRATION

§ 17.62.010. Director to administer and enforce provisions.

Except as otherwise provided in these regulations, the planning director and director of public works, or their designated representative shall administer and enforce these regulations, including the receiving of applications, the inspection of premises, and the issuance of building permits. A building permit or certificate of occupancy shall only be issued for those projects complying with the provisions of these regulations.

§ 17.62.020. Certificate of occupancy required.

  • A. Land shall only be occupied or used, or a building erected, altered or extended or changed in use upon the issuance of a certificate of occupancy by the director of public works stating that the building or proposed use complies with provisions of these regulations.

  • B. Nonconforming uses shall not be maintained, renewed, changed, or extended without a certificate of occupancy having first been issued by the director of public works.

  • C. All certificates of occupancy shall be applied for at the same time as the application for a building permit; such certificates shall be issued at the time the erection or alteration is approved.

  • D. The director of public works shall maintain a record of all certificates, and copies shall be furnished upon request to any person having a proprietary or tenancy interest in the building affected.

  • E. A permit for excavation for, or the erection or alteration of, or repairs to, any building shall only be issued after an application has been made for a certificate of occupancy.

  • F. Under such rules and regulations as may be established by the director of public works, a temporary certificate of occupancy for not more than thirty days for a part of the building may be issued by the director of public works.

§ 17.62.030. Schedule of fees.

Fees for the application of:

  • A. Amendments to the title,

  • B. Planned unit development,

  • C. Rezoning,

  • D. Use permits,

  • E. Special use permits,

  • F. Temporary use permits,

  • G. Variances,

  • H. Site plan and architectural review,

  • I. Signs,

  • J. Appeals to the city council, and

  • K. Other planning or development functions shall be established by the city council from time to time by resolution. Such resolution shall stipulate all fees applicable to these regulations at the time stipulated in the adopting regulation.

§ 17.62.040. Complaints regarding violations.

When a violation of these regulations occurs or is alleged to have occurred, any person may file a written or oral complaint with the director of public works or planning director, stating fully the causes and basis of the complaint. The director shall record promptly such complaint and immediately investigate and take action thereon as provided by these regulations. (Ord. 587, 1983)

§ 17.62.050. Violations—Penalties.

Penalties for violation of these regulations are described in Chapter 1.16 of this code and Public Resources Code Section 30800 et seq. (Ord. 587, 1983)
