Chapter 17.08 — A-1 AGRICULTURAL AND RESIDENTIAL ZONE (SINGLE-FAMILY)

§ 17.08.010. Intent.

The A-1 zone is intended for agricultural purposes as herein permitted, with appropriate single-family dwellings at a minimum lot area of two acres. (1964 Code Appx. A § 1.00)

§ 17.08.020. Permitted uses.

Buildings, structures and land shall be used, and buildings and structures shall hereafter be erected, structurally altered or enlarged only for the following uses, plus such other uses as the commission and council may deem (pursuant to Chapter 17.60 CMC) to be similar and not more obnoxious or detrimental to the public health, safety and welfare. All uses shall be subject to the property development standards in CMC § 17.08.050 through 17.08.210 :

  • A. Farms or ranches for orchards, tree crops, field crops, row crops, truck gardening, berry and bush crops, flower gardening, production and wholesale nurseries, aviaries and mushroom farms;

  • B. Single-family dwellings;

  • C. Accessory dwelling units, subject to the provisions of Chapter 17.69 CMC;

  • D. The keeping, for noncommercial purposes, of not more than three of any of the animals listed below nor more than nine total of any combination of the following animals:

    1. Domesticated parrot;

    2. Domesticated parakeet;

    3. Domesticated rabbits and hares of the family Leporidai;

    4. White or albino rats or mice;

    5. Golden hamsters of the species Mesocrietus auratus;

    6. Guinea pigs of the species Cavia porcellus;

    7. Canis familiaris (domestic dogs);

    8. Felis catus (domestic cats);

    9. Goats;

    10. Sheep;

    11. Ducks;

    12. Geese;

    13. Turkeys;

    14. Chickens;

    15. Pigeons;

    16. Doves;

    17. Local frogs;

    18. Turtles and toads;

    19. Tropical fish normally found in a pet store (no limit);

Such animals shall be maintained in accordance with CMC Title 7;

  • E. The keeping of horses or bovine animals and Vietnamese pot-bellied pigs, provided:

    1. There shall be not more than two horses or bovine animals for each acre of lot area; and

    2. There shall not be more than one Vietnamese pot-bellied pig per lot or parcel; and

    3. Such animals are maintained in accordance with CMC Title 7;

  • F. Accessory buildings and uses, including private garage, accessory living quarters, recreation room, private stable, greenhouse, lathhouse, barn, corral, pen, coop or other similar structure, and a building or room for packing products produced or raised on the same premises, subject to all provisions regarding location;

  • G. Private dance, only when conducted in conjunction with a church or school;

  • H. Sale of field and row crops grown on the premises;

  • I. Occasional sale;

  • J. Agricultural employee housing consisting of not more than 12 units designed for use by a single household or 36 beds in a group quarters in accordance with California Health and Safety Code §§ 17000 et seq.;

  • K. Two-Unit Development and Urban Lot Splits. The provisions of Chapters 16.02 and 16.06 CMC and CMC § 17.33.060 shall apply.

§ 17.08.030. Uses permitted subject to conditional use permit.

The following uses may be permitted subject to a conditional use permit as provided for in Chapter 17.62 CMC:

  • A. Farms or ranches for the grazing, breeding, raising, or boarding of horses or cattle, including riding stables or academies; provided, that the minimum lot size for such use shall be five acres;

  • B. Animal hospitals;

  • C. Churches;

  • D. Country clubs and golf courses and related driving range, tennis and swimming clubs;

  • E. Day nurseries and nursery schools;

  • F. Educational institutions;

  • G. Electric distribution and public utility substations;

  • H. Lodges and meeting halls;

  • I. Public riding stable and academy;

  • J. Rest homes;

  • K. Sanitariums and hospitals;

  • L. Private dance, when conducted in conjunction with country clubs, tennis and swimming clubs and lodges.

§ 17.08.040. Prohibited uses.

The following uses are expressly prohibited in the A-1 zone, unless otherwise set forth in CMC § 17.08.020 and 17.08.030 :

  • A. Multiple dwellings;

  • B. Commercial uses;

  • C. Industrial uses;

  • D. Hog ranches;

E. Commercial or industrial poultry or rabbit slaughtering or processing plants. (Ord. 19-07 §§ 8, 9, 2019; Ord. 04-1901 § 4, 2004; 1964 Code Appx. A § 1.03)

§ 17.08.050. Property development standards generally.

The property development standards contained in CMC § 17.08.060 through 17.08.210 shall apply to all land and buildings in the A-1 zone, except that any lot held under separate ownership or that was of record on the effective date of the ordinance codified in this title which is substandard in area or dimensions may be used subject to all other standards. § 17.08.060. Lot area.

Each lot, farm, ranch, orchard or other parcel of land shall have a minimum area of two acres. (1964 Code Appx. A § 1.04)

§ 17.08.070. Lot dimensions.

All lots hereafter created shall comply with the following minimum standards and lots now held under separate ownership or of record may not be reduced below these standards:

  • A. Each lot shall have a minimum width of 300 feet;

  • B. Each lot shall have a minimum depth of 300 feet. (1964 Code Appx. A § 1.04)

§ 17.08.080. Population density.

There shall be no more than one dwelling unit on any one lot; provided, however, that one accessory dwelling unit may be located upon the same lot as the primary dwelling unit without exceeding the density limitations prescribed herein.

§ 17.08.090. Building height – Generally.

No building or structure erected in this zone shall have a height greater than 35 feet or two and onehalf stories, whichever is less.

§ 17.08.100. Building height – Exceptions – Permitted projections above limit.

The provisions of the R-1-7500 zone, CMC § 17.26.100 , shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.110. Yards – Generally.

The provisions of the R-1-7500 zone, CMC § 17.26.110 , shall apply. The special provisions in CMC § 17.08.020(D)(2) shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.120. Front yard.

Each lot shall have a front yard of not less than 25 feet extending across the full width of the lot except for special conditions provided for below. The required front yard shall not be used for storage of trailers, boats or house trailers, or for storage of any materials. (1964 Code Appx. A § 1.04)

§ 17.08.130. Side yard.

Each lot shall have a side yard on each side of not less than 20 feet. (1964 Code Appx. A § 1.04)

§ 17.08.140. Rear yard.

Each lot shall have a rear yard of not less than 25 feet. (1964 Code Appx. A § 1.04)

§ 17.08.150. Yards – Exceptions – Permitted projections into required yards.

The provisions of the R-1-7500 zone, CMC § 17.26.150 , shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.160. Distance between buildings.

The provisions of the R-1-7500 zone, CMC § 17.26.160 , shall apply, and special provisions in CMC § 17.08.020(D)(2) shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.170. Fences, hedges and walls.

The provisions of the R-1-7500 zone, CMC § 17.26.180 through 17.26.210 , shall apply.

§ 17.08.180. Off-street parking.

The provisions of CMC § 17.72.010 through 17.72.120 shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.190. Access.

The provisions of the R-1-7500 zone, CMC § 17.26.230 through 17.26.250 , shall apply. (1964 Code Appx. A § 1.04)

§ 17.08.200. Signs.

  • A. The provisions of the R-1-7500 zone, CMC § 17.26.260 through 17.26.290 , shall apply.

  • B. In addition, signs advertising agricultural products produced and sold on the premises shall be permitted, provided:

    1. Such sign shall not exceed 25 square feet in area;
  1. There shall be not more than one such sign per 300 feet of frontage on a dedicated street.

§ 17.08.210. Underground utilities.

Utility lines including, but not limited to, electric, communications, street lighting and cable television shall be placed underground in accordance with CMC § 17.64.120 , unless special permission to construct said lines above the ground is granted. (Ord. 1251 § 3, 1974)

§ 17.08.220. Site plan review.

The provisions of Chapter 17.64 CMC shall apply. (Ord. 1679 § 7, 1988)
