§ 2-113. Generally.

The city manager shall be the administrative head of the city government under the direction and control of the city council, except as otherwise provided in this Code. He shall be responsible for the efficient administration of all the affairs of the city which are under his control. In addition to his general powers as administrative head, and not as a limitation thereon, he shall have the powers and duties set forth in sections 2-114 through 2-128 inclusive.

§ 2-114. Enforcement of laws and ordinances.

It shall be the duty of the city manager and he shall have the power to see that the laws of the State of California pertaining to the city and all laws and ordinances of the city are duly enforced, and that all franchises, permits and privileges granted by the city are faithfully observed.

§ 2-115. Control and direction of employees.

It shall be the duty of the city manager and he shall have the power to control, order and give directions to all heads of departments, subordinate officers and employees of the city, except the city attorney and the city treasurer so far as his functions as treasurer are concerned; to transfer employees from one department to another; and to consolidate or combine offices, positions, departments or units under his direction.

§ 2-116. Appointment, removal, discipline of employees.

It shall be the duty of the city manager and he shall have the power to appoint, promote, discipline, demote and remove any officers and employees of the city, except the city attorney and the city treasurer.

§ 2-117. Attendance at meetings.

It shall be the duty of the city manager to attend all meetings of the city council and its committees unless excused therefrom by the city council, except when his removal is under consideration by the city council.

§ 2-118. To advise on financial condition and needs of city.

It shall be the duty of the city manager to keep the city council at all times fully advised as to the financial condition and needs of the city.

§ 2-119. Preparation, administration of budget.

It shall be the duty of the city manager to prepare and submit to the city council the annual budget and to administer it after adoption.

§ 2-120. Purchase of supplies.

It shall be the duty of the city manager and he shall have the power to purchase or cause to be purchased all supplies for all of the departments or divisions of the city.

§ 2-121. Investigations.

It shall be the duty of the city manager and he shall have the power to make investigations into the affairs of the city and any department or division thereof, and any contract or the proper performance of any obligation running to the city.

§ 2-122. Complaints.

It shall be the duty of the city manager and he shall have the power to investigate all complaints in relation to matters concerning the administration of the government of the city and in regard to the service maintained by public utilities in the city.

§ 2-123. Supervision of public buildings and property.

It shall be the duty of the city manager and he shall have the power to exercise general supervision over all public buildings, public parks, streets and other public property under the control and jurisdiction of the city council and not specifically delegated to a particular board or officer.

§ 2-124. Service in other appointive office.

It shall be the duty of the city manager to serve in any appointive office or as head of any department within the city government for which he may be qualified when appointed thereto by the city council and to hold and perform the duties thereof at the pleasure of the city council.

§ 2-125. Leadership for civic movements.

It shall be the duty of the city manager and he shall have the power to provide leadership for civic movements designed to benefit the residents of the city, when so authorized by the city council.

§ 2-126. Ex officio member of boards and commissions.

The city manager shall be an ex officio member of all boards and commissions appointed by the mayor or the city council pursuant to law, with a right to participate in all deliberations or actions but without vote.

§ 2-127. Other duties and powers.

It shall be the duty of the city manager to perform such other duties and exercise such other powers as may be delegated to him from time to time by the city council.

§ 2-128. Reports and recommendations.

It shall be the duty of the city manager and he shall have the power to make reports and recommendations as may be desirable or as requested by the city council.

§ 2-129. Execution of contracts.

The city manager shall have the power and authority to execute contracts and documents provided for in California Government Code section 40602 whenever such contracts and documents are within the city manager's purchasing authority or have been approved by the city council for execution by the city manager by resolution, motion, minute order or other appropriate action. The city manager may delegate in writing the authority to sign any contract or agreement to the assistant city manager or a deputy city manager.
