§ 2-1. City hall designated.

That certain five-story building located at 77 Fair Drive in the city is hereby designated as the city hall.

§ 2-2. Council chamber door.

The double door through which direct entrance is made to the council chamber shall be and the same is hereby fixed, designated and established as the council chamber door for purposes of public notices.

§ 2-3. Appointment of city treasurer and city attorney; terms of office; removal.

The city council shall appoint a city treasurer and a city attorney to serve and hold office at and during the pleasure of the city council. Removal of these city officers from their respective posts shall be done in the same manner as provided for in section 2-224.5 of this Code. Where the city attorney is appointed pursuant to a contract for professional services, removal of the city attorney shall be as set forth in such contract.

§ 2-4. City council policies; commissions, boards and committees; terms and procedures.

(a) Policies adopted by city council shall have the same effect as a resolution adopted by city council.

(b) All commissions, boards and committees appointed by the city council, except as otherwise provided by the city council in this Code or by policy or as otherwise required by law, shall consist of five members with each member having a term of office of four years, provided, that in order to have overlapping terms, two or three members may initially be assigned two-year terms. The term of any member shall be automatically extended, if necessary, until his or her replacement is appointed. All members will serve at the sole pleasure of the city council and may be removed at any time without cause.

(c) The procedures applicable to commissions, boards and committees are those specified by this Code and policies adopted by city council. Where a conflict occurs, the provisions of this Code shall prevail.

§ 2-5. Bonds of clerk, treasurer and director of finance.

The city clerk, the city treasurer and the director of finance shall severally execute bonds to the city for the faithful performance of their official duties in amounts to be established as follows:

(a) The city clerk, minimum $5,000.

(b) The city treasurer, minimum $100,000.

(c) The director of finance, minimum $100,000.

The principal amounts of the bonds as set out heretofore are minimum amounts and may be increased from time to time by resolution of the city council to amounts as recommended by the city attorney.

§ 2-6. Removal of public documents.

No person shall remove from the vaults of the city, or places of deposit of the same, for the purpose of inspection or otherwise, any public document or record of the city without the permission to do so of the officer or person charged with the custody of said document or record.

§ 2-7. Public places for posting designated.

Whenever by the constitution or laws of the state or ordinances of the city, it is required that any ordinance or other official document or instrument of the city be posted in three public places, the following public places in the city are hereby designated as being the three most public places, and such postings shall be made thereat:

(a) Costa Mesa City Hall, 77 Fair Drive.

(b) Costa Mesa Post Office, 1590 Adams Avenue.

(c) Orange County Mesa Verde Library, 2969 Mesa Verde Drive East.

§ 2-8. Additional duties of policemen and firemen.

In addition to the performance of their regular and ordinary duties, it shall be the duty of all policemen and firemen at all times and under all circumstances to go to the aid of all persons, animals or property in distress or danger and render them such help and assistance as lies within their power.

§ 2-9. Injuries incurred by policemen, firemen while rendering services.

In case any policeman or fireman should be injured while rendering additional services as provided in section 2-8, he shall be deemed to be injured in the course of his employment and shall be entitled to receive compensation therefor, as provided by law.

§ 2-10. Destruction of city records.

Duplicate and obsolete records of the City of Costa Mesa shall be destroyed by a means which will not allow them to be readily restored or reconstituted, and under the following procedure:

(a) In accordance with section 34090, section 34090.5, section 34090.7 and section 53921 California Government Code and other applicable law.

(b) After application for their destruction has been approved by the city attorney or his duly authorized representative.

(c) Upon approval by resolution of the city council after the aforesaid approval by the city attorney or his authorized representative has been granted.

§ 2-11. Transfer of responsibilities—Costa Mesa Park and Recreation District.

(a) The responsibility for providing park and recreation services currently provided for by the Costa Mesa Park and Recreation District is transferred to the City of Costa Mesa, and the City of Costa Mesa by this section accepts the same.

(b) The responsibility for levying a property tax rate within such area to pay for the cost of the park and recreation program provided for by the Costa Mesa Park and Recreation District is transferred to the City of Costa Mesa, and the City of Costa Mesa by this section accepts the same.

(c) The tax rate as provided for in this section to be levied for the support of the park and recreation services, assumed by the City of Costa Mesa, shall be determined as provided for in sections 2306 through and including 2309, Revenue and Taxation Code.

(d) The tax levy provided for herein shall be effective for the fiscal year 1976-77, beginning July 1, 1976, and thereafter for each succeeding fiscal year.

(e) This section is an urgency ordinance adopted pursuant to section 36934, Government Code.

§ 2-12. Same—Costa Mesa Street Lighting Energy and Maintenance District.

(a) The responsibility for providing street lighting services currently provided for by the Costa Mesa Street Lighting Energy and Maintenance District is transferred to the City of Costa Mesa, and the City of Costa Mesa by this section accepts the same.

(b) The responsibility for levying a property tax rate within such area to pay for the cost of the street lighting program provided for by the Costa Mesa Street Lighting Energy and Maintenance District is transferred to the City of Costa Mesa, and the City of Costa Mesa by this section accepts the same.

(c) The tax rate as provided for in this section to be levied for the support of the street lighting services assumed by the City of Costa Mesa, shall be determined as provided for in sections 2306 through and including 2309, Revenue and Taxation Code.

§ 2-13. Ballot arguments and rebuttals to ballot arguments.

To the extent any city measure qualifies or is enacted to be submitted to the voters at a city election, ballot arguments for and against the measure and rebuttals to such ballot arguments shall be permitted as provided in Chapter 3 of Division 9 of the California Elections Code, Sections 9280 through 9287, inclusive. The provisions of these sections shall apply to all city elections.

§ 2-14. General municipal elections.

The general municipal elections for the city shall be held on the same day as the statewide general elections currently held in November in even-numbered years.

§ 2-15. City seal.

(a) City seal. The official seal of the City of Costa Mesa shall be in the form of a die approximately one and one-half (1½) inches in diameter, the face of which is as set forth below:

(b) Use of seal. It is unlawful and a misdemeanor for any person to make or use the seal of the City of Costa Mesa, or reproduction thereof, for any purpose other than for the official business of the City of Costa Mesa, its council, officers or departments, except upon approval of the city council by ordinance or resolution.

(c) Imitation of seal. No person shall place any imitation of the city seal on any written or printed material that is designated, calculated, intended or likely to confuse, deceive or mislead the public or cause the reader of such written or printed material to believe it to be an official city publication, and no person shall circulate or distribute any such written or printed material in the City of Costa Mesa. Any person violating this provision shall be guilty of a misdemeanor.

(d) Custodian of seal. The City Clerk of the City of Costa Mesa shall be the official custodian of the official seal of the city.
