Chapter 21.24 — SEWER MAIN CONSTRUCTION

21.24.010 - Subdivisions.¶
The requirements of Chapter 21.28 shall be fully complied with before any final subdivision map shall be approved by the governing body having jurisdiction over the proposed subdivision. The final subdivision map shall provide for the dedication for public use of streets, easements or rights-of-way in which sewer lines are to be constructed. When main sewers are to be installed outside of public streets or rights-of-way in subdivisions, the required easements shall be shown on the subdivision final map and shall be granted to the district in a separate deed of easement.
If a final subdivision map of a tract is recorded and the work of constructing sewers to serve the tract is not completed within the time limit allowed in the permit, the board may extend the time limit or may complete the work and take appropriate steps to enforce the provisions of the agreement entered into by the developer to construct the sewers.

21.24.020 - Downstream capacity.¶
Where the district determines that downstream sewers lack sufficient capacity to accept wastewater flows from a proposed development or facility, the district may require the applicant to upsize the downstream sewer as necessary to accommodate the future flows or to contribute funds toward a future upsizing by the district.

21.24.030 - Easements or rights-of-way.¶
In the event that an easement is required for the extension of the main sewer serving the owner's property in order to connect to the district sewer system, the applicant shall procure and have accepted by the board a proper easement or grant of right-of-way having a minimum width of fifteen feet sufficient in law to allow the laying and maintenance of the sewer extension or connection. Ten-foot wide easements may be provided under special circumstances only if specifically approved by the district.

21.24.040 - Cost of construction.¶
All costs and expenses incident to complete the installation of any sewer main extension, or the expansion of any sewer main, or any other work performed by a private entity for which a permit has been issued shall be paid for by the applicant. These costs shall include, but not be limited to design, construction, permitting and any other incidental costs associated with the work.

21.24.050 - Use by the public.¶
Upon completion of a sewer main extension or expansion by any entity other than the district, that sewer main shall become part of the district's sewer system for use by the public. No reimbursement of costs, as described in Section 21.24.040 above, will be made to the applicant for the main extension or expansion.

21.24.060 - Permit required.¶
In accordance with Chapter 21.28 of this title, no person shall construct, or alter a sewer main without first obtaining a written permit from the district and paying all fees and connection charges as required therein.
