Chapter 21.12 — PRIVATE SEWAGE DISPOSAL SYSTEMS

21.12.010 - Board approval required.

Upon or after July 18, 2002, no person may connect any building to a private sewage disposal system without the prior approval of the district board of directors.

21.12.020 - Sewer required.

Reference is made to Section 21.08.050 of this title, which is applicable to all buildings and developed or undeveloped properties within the district boundaries and are served by a private sewage disposal system.

21.12.030 - Operation and maintenance.

The owner shall operate and maintain the private sewage disposal system in accordance with the most current rules and regulations established by the county of Marin department of environmental health. All costs associated with the operation and maintenance of the system shall be borne by the owner.

21.12.040 - Abandonment of facilities.

When a property being served by a private sewage disposal system is connected to the district sewer system, a direct connection shall be made to the main sewer in compliance with the ordinances, rules and regulations of the district, and any septic tanks, cesspools and similar private sewage disposal facilities shall be abandoned and filled with suitable material as determined by district staff.

21.12.050 - Cost of maintenance by owner.

The owner shall operate and maintain the private sewage disposal facilities in a sanitary manner at all times, at no expense to the district.

21.12.060 - Additional requirements.

No statement contained in this chapter shall be construed to interfere with any additional requirements that may be imposed by any law, ordinance, rule or regulation or by the county of Marin department of environmental health.

21.12.070 - Permit required.

In accordance with Chapter 21.28 of this title, no person shall construct a sewer lateral or make a connection to the sewer main without first obtaining a written permit from the district and paying all fees and connection charges as required therein.
