14.05.010 - Nonstormwater Discharges.

The Following Nonstormwater Discharges are allowed under the City's General Construction Permit so long as they comply with BMPs as described in the Stormwater Pollution Prevention Plan (SWPPP), do not contain Pollutants therein, are infeasible to eliminate, do not require a Nonstormwater Permit from the Regional Water Quality Control Board, Santa Ana Region, are not prohibited by the basin plan and do not cause or contribute to Violations of any water quality standards or Federal, State or Local Law or regulation:

A. Landscape irrigation or erosion control measures;

B. Waterline flushing and testing as provided for in Section 14.02.060;

C. Street cleaning;

D. Tree watering;

E. Dust control; and

F. Soil compaction.

14.05.020 - Best Management Practices.

It is the User's responsibility to adopt and implement appropriate Best Management Practices as set forth in Section 14.03.040. Although it is the User's responsibility to adopt and implement appropriate BMPs, the Director is authorized to impose BMPs on all Construction Activity, and the failure to implement such BMPs Shall be a Violation of this title.

14.05.030 - Permits required.

Any Person intending to engage or engaging in Construction Activity covered by the State Water Resources Control Board's general Permit for Discharges of Stormwater associated with Construction Activity, or any revision, modification, reissuance or replacement thereto, Shall comply with the applicable order; comply with Section 14.02.070 of this title; and provide evidence of compliance prior to obtaining any City-issued grading or construction Permits.

14.05.040 - New Development and redevelopment.

A. Contractors and Owners constructing new Development or Redevelopment Projects subject to the State Water Resources Control Board's general Permit for Discharges of Stormwater associated with Construction Activity, or any revision, modification, reissuance or replacement thereto, Shall develop and implement a SWPPP prior to disturbing the proposed construction site. All such contractors and Owners Shall control Stormwater runoff so as to prevent any deterioration of water quality that would impair subsequent or competing Uses of the water. All such contractors and Owners Shall develop and implement a monitoring program with the inspection Components required by the State Water Resources Control Board. The Director May identify the BMPs that Shall be implemented to prevent such deterioration and Shall identify the manner of implementation. The BMPs may, among other things, require new Developments or redevelopments to do one or more of the Following:

  1. Increase permeable areas by leaving highly porous soil and low-lying areas undisturbed; by incorporating Landscaping and Open Space into the Project design; by using porous Materials for or near Driveways and walkways; and by incorporating detention ponds and infiltration pits into the Project design;

  2. Direct Stormwater runoff to permeable areas by directing it away from swales, Berms, green strip filters, gravel beds, and french drains; by installing rain gutters oriented towards permeable areas; by modifying the Grade of the Property to divert flow to permeable areas and minimize the amount of Stormwater runoff leaving the Property; and by designing Curbs, Berms or other Structures such that they do not isolate permeable or landscaped areas; or

  3. Maximize Stormwater storage for reuse by using retention Structures, subsurface areas, cisterns or other Structures to store Stormwater runoff for reuse or slow release.

B. Construction activities, which cause or contribute to a Violation of water quality standards, Must be corrected immediately. Within fourteen calendar Days of the Violation, the contractor or Owner Must provide a report to the Regional Water Quality Control Board, Santa Ana Region and to the City of the corrective action taken.
