Sec. 5-5.01. - Drinking on streets, sidewalks and alleys.

Any person who drinks intoxicating liquor of any kind upon any public street, sidewalk, or alley in the City shall be deemed guilty of an infraction unless permitted by the City Manager under Section 5-5.02.

Sec. 5-5.02. - Applications for special permit.

To obtain a special permit allowing the consumption of alcoholic beverages on a City street, sidewalk or alleyway an application shall first be made to the Police Chief and approved by the City Manager. Subject to such conditions as the City Manager may impose, a special permit allowing the consumption of alcoholic beverages on a City street, sidewalk or alleyway may be issued by the City Manager for one (1) of the following purposes:

(a) Community events which do not restrict public attendance; and

(b) Special events which do not restrict public attendance which are sponsored by local nonprofit organizations.

Sec. 5-5.03. - Special permit fee.

Before the issuance of a special permit fee as required by this chapter, the Police Chief shall collect a permit fee in the amount of twenty-five dollars ($25.00), or such other amount as the Council may establish by resolution.
