14-2.1 General Prohibition.

It is unlawful for any person to make or cause to be made any non-storm water discharge into the City storm drainage system or directly to natural surface waters, except as allowed by the Municipal Storm Water Permit. (Ord. #2006-126, 14.090)

14-2.2 Exception to Discharge Prohibition.

The Director may prepare and update the list of authorized non-storm water discharges and circumstances under which these discharges may be allowed in the City Storm Water System pursuant to the Municipal Storm Water Permit. (Ord. #2006-126, S14.100)

14-2.3 Prohibited Storm Water Discharges.

It shall be unlawful for any person to discharge or cause to be discharged any storm water or material that causes or contributes to causing the City to violate water quality standards, the City’s obligations under the Municipal Storm Water Permit, or any State-issued discharge permit. (Ord. #2006-126, S14.110)

14-2.4 Prohibition of Illicit Connections.

The construction, use, maintenance or continued existence of illicit connections to the storm drain system is prohibited. This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection. 14-2.5 Waste Disposal Prohibitions.

No person shall throw, deposit, leave, maintain, keep, or permit to be thrown, deposited, left, or maintained, in or upon any public or private property, driveway, parking area, street, alley, sidewalk, component of any storm drain system, or water of the United States any refuse, rubbish, garbage, litter, or other discarded or abandoned objects, articles, and accumulations, so that the same may cause or contribute to pollution. (Ord. #2006-126, S14.130) 14-2.6 Discharges in Violation of Industrial or Construction Activity NPDES Storm Water Discharge Permit. Any person subject to an industrial or construction activity NPDES storm water discharge permit shall demonstrate that he/she has obtained coverage under, and is complying with the required permits. Proof of coverage and compliance with said permit shall be required in a form acceptable to the Director to or as a condition of a subdivision map, site plan, building permit, or development or improvement plan, upon inspection of the facility, during any enforcement proceeding or action, or for any other reasonable cause.
