Clearlake Municipal Code § 1-6 Adopting by Reference Portions of the Lake County Code

1-6.1 Preamble.

The City Council of the City of Clearlake on November 19, 1980 adopted its Ordinance No. 1 pursuant to the provisions of California Government Code Section 35441 adopting all ordinances of the County of Lake for a period of one hundred twenty (120) days after that date; and the City Council of the City of Clearlake seeks to provide for the continued applicability of certain portions of the Lake County Code within the boundaries of the City of Clearlake after the expiration of the one hundred twenty (120) day period; and California Government Code Section 5022.9 authorizes a city to adopt county ordinances and codes by following the procedure outlined therein. 1-6.2 Adoption by Reference.

The following sections of the Code of Lake County, California, are incorporated herein by this reference and are hereby adopted as and for ordinances of the City of Clearlake. a. Sewer Use Ordinance: Appendix A (all) See Chapter XI, Sanitation The catchlines of the several sections of the Lake County Code contained within the foregoing reference are intended as mere catchwords to indicate in general the contents of some of the sections but shall not be deemed to be part of the section nor to limit the content of the provisions referred to by chapter or article number and herein adopted. (Ord. #12, S1) Editor’s Note: In such instances where amendments to the County Code have been placed into corresponding chapters, further amendments and repeals will be noted in the specific chapter.

1-6.3 Amendment of Ordinances Adopted by Reference.

The various sections of the Lake County Code adopted by reference by the City of Clearlake pursuant to subsection 1-6.2 are hereby amended in the following respects: a. Whenever the words “Board of Supervisors” are used, they shall be construed to mean the City Council of the City of Clearlake.

b. Whenever the word “county” is used, it shall be construed to mean “the City of Clearlake” except if the word “county” modifies, precedes, or is otherwise used to identify a county or officer where it shall continue to mean “Lake County.” c. Wherever the words “unincorporated area” are used, they shall be construed to mean “the City of Clearlake.” (Ord. #12, S2)
