9.08.010 - Consumption or possession on unlicensed premises.¶
It is unlawful for any person to possess or to consume from any bottle, can or other receptacle containing any spiritous, malt, vinous or alcoholic beverages which has been opened, or a seal broken or the contents of which have been partially removed, in any place open or accessible to the general public, which is not licensed to permit such possession or consumption.

9.08.020 - Consumption or possession in or on streets or other property open to view.¶
It is unlawful for any person to possess or consume from any bottle, can or other receptacle containing any spiritous, malt, vinous or alcoholic beverages which has been opened, or a seal broken or the contents of which have been partially removed, in or on any street or sidewalk; or any passageway open to public use; or in or on any park, playground or community house; or in an automobile while the automobile is on any alley, street, highway, public property, or open to public view; except that this section shall not pertain to the premises of a residential dwelling as long as such consumption is with the authorization of the residential dwelling owner.

9.08.030 - Permit to allow consumption in public places.¶
The chief of police may issue a permit allowing consumption/possession of alcoholic beverages in places prohibited by this chapter upon proper application to the chief of police on forms available at the police department. This application must be completed thirty days prior to the date the public consumption is requested. The permit shall not be granted if in the opinion of the chief, the safety or well-being or appearance of the city will be adversely affected or if prior experiences have shown the issuance of the permit would not be in the best interests of the city. The applicant may appeal to the city administrator a refusal to grant a permit by the chief of police. The permit will specify the geographical boundaries in which consumption of beverages will be allowed, and any consumption outside of this boundary will be considered a violation of this chapter.

9.08.040 - Violation—Penalty.¶
Any person who is convicted of a violation of any of the provisions of this chapter is guilty of an infraction and shall be punished as provided in Section 1.16.010B.
