16.04.010 - Definitions—Generally.

A. The words and phrases set forth in this chapter shall have the meanings respectively ascribed to them.

B. Whenever words or phrases are used in this title and are not defined in this chapter, but are defined in the Subdivision Map Act of the state of California, such definitions are incorporated herein and shall be deemed to apply as though set forth in this chapter.

C. All officers referred to in this title shall mean the respective employees of the city or the county of Santa Barbara (where expressly so designated) or their duly authorized deputies or representatives, unless a different intent is expressed in this title. In the event no such employee or post of the city shall have been created or filled, all duties and functions of such employees of office pursuant to this title shall be done and performed by the city manager.

16.04.020 - Building site.

"Building site" means a validly created lot or parcel of land containing not less than the prescribed minimum area required by any applicable subdivision and zoning ordinances, codes and regulations existing at the time of the creation of the lot or parcel and occupied or which can legally be occupied by buildings or structures.

16.04.030 - City council.

"City council" means the city council of the city of Carpinteria.

16.04.040 - Division.

"Division," "division of land" or "divided" means any separation of land into two or more parts or parcels or any modification or adjustment of lot lines.

16.04.050 - Lease.

"Lease" for the purposes of this title means the renting of real property, but shall not include any lease which does not create a building site, such as, but not limited to, the renting of apartment units, offices, stores or similar spaces within a building, or mineral, oil or gas leases or trailer spaces within trailer parks.

16.04.060 - Opening of a new street.

The terms "opening of a new street" or "opening of a new road" means the reservation of right-of-way or easement by map or deed, or the improvement of an existing unimproved right-of-way for the purpose of vehicular travel.

16.04.070 - Original parcel.

"Original parcel" means an area of land under common ownership shown as a unit or as contiguous units on the latest available assessment rolls of the county of Santa Barbara, even if separated by a street, road, railroad or public utility easement.

16.04.080 - Owner.

"Owner" means any individual, association, syndicate, copartnership, corporation, trust or any other legal entity having legally protected interest in the land sought to be divided.

16.04.090 - Planning commission.

"Planning commission" shall mean the planning commission of the city.

16.04.100 - Street—Road.

The word "street" and the word "road" shall be construed to include public and private rights-of-way which afford a means of vehicular access to property; provided, however, that a private easement, right-of-way or extension thereof shall not be construed to be a "street" or "road" where such private easement, right-of-way or extension thereof cannot be reasonably expected to serve more than four existing or future building sites under the presently applicable zoning and subdivision regulations.

16.04.110 - Subdivision.

"Subdivision" means the division, by any subdivider of any unit or units of improved or unimproved land, or any portion thereof, shown on the latest equalized county assessment roll as a unit or as contiguous units, for the purpose of sale, lease or financing, whether immediate or future except for leases of agricultural land for agricultural purposes. Property shall be considered as contiguous units, even if it is separated by roads, streets, utility easement or railroad rights-of-way. "Subdivision" includes a condominium project, as defined in Section 11004 of the Business and Professions Code. Any conveyance of land to a governmental agency, public entity or public utility shall not be considered a division of land for purposes of computing the number of parcels. As used in this section "agricultural purposes" means the cultivation of food or fiber or the grazing or pasturing of livestock. This definition shall not prevent a purchaser of a unit of land created under this title, or any previous subdivision ordinance from subdividing such land one time, pursuant to the provisions of this title, prior to the time and an equalized county assessment roll has been completed reflecting the creation of the unit proposed to be subdivided.

16.04.120 - Subdivider.

"Subdivider" means a person, firm, corporation, partnership or association who proposes to divide, divides or causes to be divided real property into a subdivision for himself or for others, except that employees and consultants of such persons or entities, acting in such capacity, are not "subdividers."
