8.08.010 - Detonation.

No person shall detonate or use any explosive without first having obtained a written permit from the chief of police or other officer designated by him.

8.08.020 - Permit required.

Any person desiring to obtain a permit to detonate or use explosives shall file with the chief of police a written application, signed by the applicant, containing a description of the premises wherein or whereon such explosive is to be detonated or used. The chief of police shall issue a permit only if he finds that its use will not jeopardize or seriously menace the public peace, health or safety, and for the purpose may consider any facts or evidence bearing on the location where the proposed explosive is to be detonated or used, the experience of the applicant, and the ability of the applicant to respond in damages for such injuries as the detonation or use might cause. The chief of police may issue such permit subject to such reasonable conditions as he finds will tend to reduce or eliminate danger to the public peace, health or safety; and every such permit shall contain a description of the premises, the name of the person to whom the permit is issued and the hours between which the explosive shall be detonated or used. It is unlawful for any person to detonate or use any explosive contrary to the provisions of this section or contrary to the conditions of any such written permit.

8.08.030 - Revocation of permit.

The chief of police may summarily revoke any permit issued under the terms of Section 8.08.020, when he finds that its use, is or is liable to become, dangerous to the public peace, health or safety. Any person whose permit has been revoked or to whom a permit has been refused to detonate or use any explosive may appeal to the city council from the ruling of the chief of police. The decision of the city council as to the hazard of the proposed use and as to the reasonableness of any condition imposed upon any permit issued by the chief of police, or by the council following an appeal, is final.

8.08.040 - Explosives defined.

As used in this chapter, the term "explosive" means any of the substances named or described in Section 12000 of the Health and Safety Code of the state of California.

8.08.050 - Penalty.

It is unlawful for any person, firm or corporation to violate any provision, or fail to comply with any mandatory requirement of this chapter. Any person, firm or corporation committing any unlawful act under this chapter shall be guilty of a misdemeanor pursuant to Section 1.04.010 of this code.
