5.12.010 - Entertainment permit.

A. No person shall own, operate or manage any place having entertainment unless such owner, operator or manager has received a permit from the city authorizing entertainment in accordance with the provisions of this title. An entertainment permit is not required if the person is required to obtain a special event permit.

B. "Entertainment" means any live entertainment presented, furnished, allowed or permitted at any public place on a regular basis, including any place where food or beverage is sold, offered for sale, or given away.

5.12.020 - Dancehall permit.

A. No person shall own, operate, or manage any dancehall, unless such owner, operator or manager has received a permit authorizing a dancehall in accordance with the provisions of this title.

B. Hours of Operation. No public dance shall be permitted to operate between the hours of two a.m. and six a.m. of any day; nothing herein restricts the ability of the city to impose more restrictive hours under the city's general police power. No person having charge of any public dancehall shall allow or permit any person except such person in charge thereof or the employees regularly employed therein to remain therein between the hours of two a.m. and six a.m. of any day.

C. Minors. No minor under the age of eighteen years shall be, and no person in charge of any public dancehall shall allow or permit any person under the age of eighteen years to be, remain in, enter, attend or visit any public dancehall, or the room or rooms in which such dance is being held or conducted, unless such minor is accompanied by his or her parent or guardian. This section shall not apply to any public dancehall where the dance being conducted therein is exclusively for minors.

D. The provisions of this section shall not apply to places regularly and daily engaged in carrying on and conducting a hostelry, cafe, bar or restaurant where such business constitutes a material part or a portion of such enterprise.

5.12.030 - Entertainment/dancehall permit—Application contents.

An application for entertainment and dancehall permits shall contain the following information:

A. The name and address of the applicant;

B. The name and address of the person by whom employed, if any;

C. The nature of the business for which a permit is requested;

D. The place where such business is to be conducted;

E. The name under which the business is to be conducted;

F. A personal description of the applicant; and

G. Evidence of the identity of the applicant, as may be required by the director.

5.12.040 - Duration of entertainment and dancehall permits.

Any permit issued pursuant to this chapter shall remain in effect, unless revoked, so long as there is a valid business tax certificate in effect for the business.

5.12.050 - Revocation of permit.

Revocation of a permit issued pursuant to this chapter shall be as provided for in Section 5.08.050.

5.12.060 - Appeals.

Appeals from any decision of the director are subject to the procedures provided in Section 5.08.060.
