10.38.010 - Gambling places prohibited.¶
Except as otherwise provided in this chapter, no person may maintain or cause to be maintained within the city any property used for gambling, where any game not mentioned in Section 330, 330a or 337a of the California Penal Code, is played, conducted, dealt or carried on with cards, dice, balls, billiard balls, pool balls, cues or other device for money, checks, chips, credit or any other representative of value, or for merchandise or for anything of value.

10.38.020 - Playing or betting prohibited.¶
Except as otherwise provided in this chapter, no person may play or bet at or against any game not mentioned in Section 330, 330a, or 337a of the California Penal Code, which is played, conducted, dealt or carried on within the city with cards, dice, balls, billiard balls, pool balls, cues or other device for money, checks, chips, credit or any other representative of value or for any merchandise or anything of value.

10.38.030 - Exceptions for charitable fundraising events.¶
The prohibitions on gambling in this chapter do not apply to controlled games at a charitable fundraising event conducted by a nonprofit organization, if the charitable fundraising event meets all of the following conditions:
A. The nonprofit organization conducting the charitable fundraising event must qualify for and secure all required approvals for the event prior to the start of the event.
B. The charitable fundraising event must be conducted in accordance with the applicable provisions of Business and Professions Code sections 19985 through 19987, which specifically authorize eligible nonprofit organizations to conduct controlled games as fundraisers under specified circumstances.
C. Only "controlled games" as defined in California Penal Code Section 337j(e) may be played at the charitable fundraising event.
D. The nonprofit organization may hold only one charitable fundraising event involving controlled games per calendar year.
E. The charitable fundraising event may not last more than five consecutive hours.
F. The nonprofit organization conducting the event must check or cause to be checked the identification of participants to ensure each participant is of at least 21 years of age.
G. In accordance with the Business and Professions Code Section 19986(c), no cash prizes or wagers may be awarded to participants, however, the winner of each game may be entitled to a prize from those donated to the charitable fundraising event. An individual prize awarded to each winner may not exceed a cash value of $500.00, and the total cash value of prizes awarded at a single event may not exceed $5,000.00.
H. In accordance with the Business and Professions Code Section 19986(d), at least 90 percent of the gross revenue from the charitable fundraising event must go directly to the sponsoring nonprofit organization.
