1.24.010 - Violation deemed misdemeanor—Exception.

Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code shall be guilty of a misdemeanor, unless the violation is made an infraction by ordinance.

A. Any provision or requirement of this code or otherwise as referred to above, the violation of which or the failure to comply with which, is designated as an infraction, may be prosecutable as a misdemeanor after a third conviction, nolo contendere plea, or final determination on an administrative or civil citation.

B. Notwithstanding the above provisions, a violation of any provision of this code or any code adopted by reference by this code, or any other city ordinance or permit condition may be charged as an infraction at the discretion of an enforcement official or his designee and may be the subject of a civil citation pursuant to Chapter 1.24 of this code.

An enforcement official as defined in this section is the city manager, city attorney, chief of police, planning director, public works director and chief building inspector.

1.24.020 - Penalty—Misdemeanor.

Except in cases where a different punishment is prescribed by this code, any person convicted of a misdemeanor for violation of this code is punishable by a fine of not more than one thousand dollars, or by imprisonment not to exceed six months, or by both such fine and imprisonment.

1.24.030 - Penalty—Infraction.

Any person convicted of an infraction for violation of this code is punishable by:

A. A fine not exceeding one hundred dollars for a first violation;

B. A fine not exceeding two hundred dollars for a second violation of the same ordinance within one year;

C. A fine not exceeding five hundred dollars for each additional violation of the same ordinance within one year.

1.24.040 - Each day deemed separate violation.

Each convicted person shall be guilty of a separate offense for each and every day during any portion of which any violation of any provision of this code is committed, continued or permitted by any such person, and he shall be punishable accordingly.
