15.16.010. - Defined.

For the purpose of this chapter, the term "satellite receiving antenna" means any dish antenna or antenna of any and every other description, and of any configuration, together with appurtenant equipment, whose purpose is to receive communication or other signals from orbiting satellites or other extraterrestrial sources.

15.16.020. - Regulations designated.

No satellite receiving antenna having a dimension of more than one meter (39.4 inches) in length, width, or height, exclusive of appurtenances thereto, is permitted in the city unless it complies with all of the following:

A. Prior to installation, the owner of the real property upon which such satellite receiving antenna is proposed to be placed shall obtain a building permit from the department of public works, which department shall, prior to the issuance of such building permit, require submission to that department of a site map, together with a copy of the manufacturer's installation instructions. The department of public works shall not issue a building permit until it is satisfied that the proposed installation complies with either the manufacturer's recommended installation instructions, or other installation satisfactory to the department, and has reviewed and approved the site map in accordance with the provisions of this chapter.

B. The satellite receiving antenna is not located within a front yard setback.

C. Satellite receiving antennas placed behind the front yard setback of a residential zone shall be screened from view of the streets by use of fences, hedges or appropriate plant materials.

D. The maximum height of the satellite receiving antenna to the highest point of the antenna and its appurtenances does not exceed 20 feet, in any zone.

E. No part of a satellite receiving antenna shall be located closer than five feet to the nearest property line in any position during its movement through the limits of its arc.

15.16.030. - Permit required for noncomplying antenna.

Any person desiring to install a satellite receiving antenna which does not comply with one or more of the provisions of this chapter may apply to the planning commission for a use permit which may be granted by the planning commission, in its discretion, after due notice and public hearing, upon a finding that the installation of such satellite receiving antenna, upon such conditions that the planning commission in its discretion shall impose, is not more obnoxious than would be the installation of such satellite receiving antenna if it were otherwise in compliance with this chapter.
