Chapter 1.16 — GENERAL PENALTY

1.16.010. - Designated.

A.

Notwithstanding any other provision of this Code, when in this Code or in any ordinance of the city any act is prohibited or is made unlawful, the same may be charged as an infraction or misdemeanor, unless by the terms of the ordinance, the penalty is specially stated therein.

B.

When any person is arrested for a violation of this Code, the arresting officer may issue a written promise to appear. Such notice to appear will provide for a ten days' notice to appear before the magistrate within the judicial district within which the offense occurred. When the person arrested refuses to give their written promise to appear, the person shall be taken without unnecessary delay before a magistrate within the judicial district within which the offense occurred.

C.

Every day that any violation of this Code or any other ordinance of the city continues shall constitute a separate offense.
